More stupidity out of Florida: 18-year-old high school girl arrested/charged for consensual relationship with "underage" student

Kaitlyn Hunt was a 17-year-old lesbian high school student, and got involved with another girl, who was 14 at the time.

The younger girl's parents were unhappy about this relationship. It is unclear if it's because it was a lesbian relationship, or because of the age difference, but I'm guessing the former. They waited until Kaitlyn turned 18, then reported her to the police.

Kaitlyn was arrested and charged with two counts of lewd and lascivious battery of a child 12 to 16 years of age as a result of the relationship. The prosecutor's office will not drop the charges.

Ignoring the lesbian aspect of this (which is what's getting everyone's attention), I always felt that laws like this were really stupid. California, for example, makes it a felony for two teenagers one day apart in age to have sex if the "older" one is 18 today and the "younger" one turns 18 tomorrow. This is obviously not the spirit of the law, but it's the one on the books.

Florida's law makes it a crime for anyone over 18 to have a sexual relationship with anyone under 17, meaning an 18-year-old senior in high school would be committing a crime by having sex with a 16-year-old junior.

Again, laws that criminalize sex with minors should only target older (or at least somewhat older adults), and should always take into account the age difference between the two parties. If the age difference is reasonable to where it could be considered a normal relationship between teens, there should be no crime.

Some states have a "4-year-rule", where it is not a crime to have sex with a minor if the minor is at least 14 and not more than four years younger than their partner. I support this law, as it essentially protects all high school students from statutory rape charges when dating one another, and is allows reasonable relationships such as a 17-year-old dating a 20-year-old. At the same time, it punishes older perverts who prey upon teenagers.

Nevada actually has an age of consent of 16, which I think is wrong. I don't think guys my age should be allowed to legally have sex with minors under any circumstances, but Nevada allows it, while at the same time, criminalizing a relationship between an 18-year-old and a 15-year-old.

I think all of these laws need to be updated.

Unfortunately, this most important aspect of the story is getting drowned out by the "OMG gay persecution" screams and the "wow, look at the hot 18-year-old girl getting arrested for lesbian sex" gawking.

It's like any law. 99% it protects, 1% it fails. Most of the 1% it fails can get out of it if they have good attorneys.

If you did not have laws like this, 30 something guys would be hanging out at high school parking lots with drugs, alcohol and cigs.

This is an extreme example. I agree with the law. A couple people each year might get burned, but that is life.

If they changed the law to a 4-year-rule, 30-year-old guys would still be committing the same crime by having sex with teenagers.

The laws are stupid if the sex is consensual and between teens it's hard to put an age limit on that.

When teens hit puberty their hormones are going wild. As long as nobody gets raped if they screw around then they shouldn't be punished but hopefully they will use protection. That goes for straight people but for parents of kids who are homosexual or bi-sexual it's hard for them to stomach the fact their kid isn't straight. The parents feel their "out" is blaming the other teen for brainwashing their kid when a lot of times that isn't the case.

Parents get involved and things go crazy attempting to punish a teen too strongly for something which if it wasn't rape or another form of molestation should have no merit for a legal case.

Still the same issue though. A 22 year old guy could be hanging around parking lots swearing the 14 year old told him she was 18.

The law should be anyone in HS can date, and if you graduate you accept what you get if parents turn on you.

I used to know a dude that would go back from college at age 21 and bang his 16 year old girlfriend. That was fucking creepy. She had twin kids at age 20 and divorced at age 22. No idea where either went but it was a fucking mess.

They would never put even close to that many pictures up of a guy. It seems to me people would be more likely to read about this story regardless since it was a girl since most cases it's involving a boy.

I'm sure some pervs might want to look at this girl but she has a weird looking face to me. That could change when she gets older but in a non-pervert kind of way their are a lot of girls you can tell they will be very pretty when they get older but with this girl at least to me I just don't see it. She looks like she would be the type who will bake her skin five days a week at a tanning booth and age quickly from that.

This is going to sound weird but as a parent of a teen who's hormones are just beginning to rage, I would personally be grateful as hell if her sexual exploration was with another girl, instead of a boy. The outcomes would be so much less damaging for her life.

This. I know someone on the sex offender registry because he went to a bar and ended up taking home a girl who was under 18 but got in with a fake ID and claimed to be in her 20s and looked it. He's no predator, he's a very nice guy, but his face, address, etc are on the Internet labeling him as a sex offender forever. It's terrible.

As fucked up as it is, this girl should have taken the plea deal which would have had her pleading guilty to felony child abuse, but I don't think serving time. Now she is fucked. Obv she is in the right, but the law is the law and they aren't going to rewrite it to appease her situation, especially in FL. She will be convicted, most likely will serve time and will be labeled a sex offender the rest of her life.

Edit: Just saw the plea deal meant accepting sexual offender charges too. She was fucked either way.

I read some statements from the 14-year-old's parents that they asked the 18-year-old to stay away from their daughter.

If they really did this, and she still persisted with the sexual relationship, then she is more at fault here than I initially thought.

It's one thing to date someone a few years younger than you, who is technically underage by law.

It's another to give a big "fuck you" to the underage girl's parents if they object. That's just stupid and putting yourself at risk for exactly this.

This is happening not too far from where I am living atm. I having obv been in trouble in Florida, know all too well how serious the law in Florida is.

I truly hope for this girls sake, she has a really powerful firm defending her. Most lawyers down here are terrible, especially in this area. Not taking that plea-deal was a risky play. I agree with it obviously, but if she goes to trial and loses, it will ruin her life. The problem is going to be proving beyond a reasonable doubt, that what she did does not violate Florida law as it is written. Not in the court of public opinion. And technically she did. I know its ridiculous, as is such with some of Florida law, it can be ruthless.

She does not belong in prison, let alone to be listed as a sex offender for the rest of her life. She seems very bright and still very young. This is going to show the outlandish, strong-arm, of the Florida law to a lot of people who may not have previously known and/or cared about.

I wish her luck, she will need it. The States not going to drop this but, in offering a plea deal like that means, shes being treated on the low end of this spectrum, which is good. Although the damage is still done. Hopefully she can write a book or ink a major motion picture at some point to help this girl out after this mess is all said and done. Which could not be for 10 years or more, after serving time probation etc assuming she is convicted.


She doesn't deserve this to the extent she is being tried, at all. Kind of makes me mad actually. And locally having small talked with a few about it, I have not heard anyone yet here, say they actually agreed with the State on this. Granted it was only a few conversations, but the consensus seems to be, Florida is totally de-ranged on this one.

I saw an interview with them on CNN. They seemed sincere, almost apologetic in a way. I don't think they just waited till the day this girl turned 18 to call the cops. It was an ongoing situation.
