    Federal Trade Commission could look into DFS sites after controversy

    United States Sen. Robert Menendez and Congressman Frank Pallone have asked the Federal Trade Commission to investigate daily fantasy sports operators who allowed employees with access to nonpublic information to compete on rival sites.

    "Allowing employees of fantasy sports websites with access to nonpublic information to participate in online fantasy games, even if the games are operated by other fantasy sports companies, could give those employees an advantage akin to insider trading," Menendez and Pallone stated in an Oct. 6 letter to the FTC. "Therefore, we also ask the FTC to investigate whether this constitutes an 'unfair or deceptive practice' as defined in Section 5 of the FTC Act.

    DFS ad spending was slashed post-scandal. DraftKings fell out of top 10 advertisers for first time all year.

    I'm pessimistic on DFS in just about every way but the New York Times is really going balls out to trash the industry and decidedly thin on journalistic facts. Way less facts than they've had for willfully unpublished stories like, say, illegal domestic surveillance or widespread murder by certain governments in faraway dry hot climates. I'm curious what the deeper motivation is here beyond general tabloidery.

    I don't have any sympathy for Aguiar unless he comes forward and honestly clears up what's going on with DraftKings and the access employees have to confidential data.

    His individual role in this doesn't really matter much in the grand scheme of things.

    closest I've found him talking about any type of getting on DK in a non-DFS state (AZ) was for checking lineups, but nothing nefarious or anything about playing

    Great news. The independent law firm independently hired by DraftKings to independently review the situation has independently confirmed that Ethan Haskell had locked in his picks 40 minutes before receiving the inside statistical info.

    That settles that.

    Interestingly, they hired Greenberg Traurig to do the investigation.

    That's a major firm (1800 lawyers), and they represented Mason Malmuth in his successful lawsuit against Dutch Boyd.

    But yeah, this is all bullshit.

    Pretty sure DraftKings just manipulated the data and then had Greenberg Traurig "investigate" from that point forward.

    Even if the shill "investigator" hired to cover up the scandal were taken at face value, the data Ethan Haskell leaked is extremely valuable to DraftKings players even if useless on FanDuel. There was zero excuse for him, or anyone else, to have access to it.

    Of course it was just an isolated one-off breach to that lone employee and nothing of the sort ever happened before or since...................

    DFS representatives testified before NJ legislature yesterday. When asked what the highest stakes being played were, they stammered and had no clue.

    These companies are such horrible pieces of shit. God I wish they'd do an IPO.

    Also, the NFL owners are probably going to be forced to sell their equity positions by the league. Next owners meeting is December 2nd. Kind of expected, but there may also be some legal charges to come out of this mess also imo, while also simultaneously declaring it 'gambling'.
