Moral of the story is that PLOL would still have that domain if he had consulted the peanut gallery here first before caving to the Injuns.
But maybe they paid him off handsomely and he got the last laugh.
Allllright, part 2. Hopefully you don't think the long wait means part 2 is going to be super epic. Because it really isn't. If you didn't figure it out, the black guy staring at me in the lobby was a process server who was supposed to hand deliver the letter to me, but gave up. I'm guessing he had an outdated picture of me, and wasn't sure if I was the person he was supposed to spot or not. It was also interesting that the Seminoles didn't use one of their in-house lawyers to handle this matter. They contacted an outside law firm that specializes in trademarks.
So, the first thing I did was call up a lawyer to get a consultation on what I should do. Many of the things stated in the letter were flat out untrue. I did nothing to 'cause confusion among customers'. I wasn't 'diverting business' from them, and I certainly wasn't implying a 'non-existent relationship' with the Indians. The lawyer thought I had a pretty strong case, except for one thing. I had played in the SHRPO tournament. Because of this, it would make it easier for them to establish that I acted in 'bad faith'. He said I could still try to fight it, but that he wouldn't recommend it because it would be very costly and I might still lose (and owe their legal fees). I wanted to call them up and be like "Look, neither of us want to go through a costly court battle. Just give me $5k for the name and we'll move on". But I thought they might refuse out of principal, and sue me anyway. They weren't asking for any money, so I decided to just give up and agree to hand over the domain.
I e-mailed the lawyer and she gave me instructions on how to transfer the domain over to them. I went to transfer the domain name and I got this error:
Basically the credit card that the Indians had on file was no longer valid, so the registrar couldn't charge them the $9 needed to transfer the domain name.
Anyway, I had them update their CC and transferred the domain name to them and they are now the proud owners of SHRPO.com and .net (until they forget to renew their domains). I'm still not sure how I feel about my decision. I feel I had some case against the Indians, but I wasn't about to gamble with a significant portion of my life roll to find out. In the end, it was easier to just lie down and take it (something I have a decent amount of experience in).
My sister went to the great Florida State University, whose mascot is the Seminoles. I went along with her during her orientation, and the orientation leader told us something interesting. The Seminoles have never been defeated in battle. This is something that the Seminole people are very proud of. Well, unfortunately this still holds true. Good game, Seminole Indians. You did your people proud.

did you trademark it? plan to use it for something. or was it not trademarked and you did nothing?
was this website acronym name even a thought from the tribe or casino?

You remind me of my idiot buddy that got divorced from his long time gf/ short time wife who went into the divorce proceedings without a lawyer while his ex wife went into the proceedings with a lawyer, who was her father. why not get a lawyer with some balls. How could the court make you pay the Seminoles court costs of you beat them to the wire?
I did not plan to use it for anything, and I did not trademark it. You can't just trademark something unless you have a legitimate business use for it. SHRPO could stand for some other nonsense, and I could claim that, but because they knew I was a poker player it would be very hard for me to make that case. Basically I can't just register a domain name that is similar to an existing trademark, with the intention of selling it to that trademark holder at a later time. Even if it's not the exact same trademark. SHRPO is dissimilar enough from 'Seminole Hard Rock Poker Open', to where I could easily plead ignorance. But because of the timing of when I bought the domain name, and the fact that I played in the tournament, it would be hard for me to claim that I didn't know what the 'Seminole Hard Rock Poker Open' was.
I actually respect the lawyer for being honest with me. He basically said that he didn't want to take the case because it would cost me a bunch of money. I didn't pay the lawyer anything for the consultation. I less-ethical lawyer would have advised me to fight it so that he could charge me a bunch of legal fees.
I also got a second opinion from my friend who went to law school and passed the bar (but isn't a practicing lawyer). He also advised that it's best to just hand over the domain name.
You got very wise advice and heeded it. You would have lost for the simple reason you played in the tournament the same time you basically registered it. A lot of people get caught up in the whole WWF/WWE domain example and it is never relevant to cases of squatting, which this was. With all that said PLOL caught a break and did not push it and all is well in South Chicago.
Yeah that was pretty much your only play here. When you're drawing dead it's best to fold. Next time have yebsite register the domain obv.

You caught the Seminoles being Seminoles and put a stake on your internet claim. There is no correlation between playing a gay ass Poker tourney and registering a 5 letter domain before the tourney, nothing malicious wad done or said. Just complete pussification of your inherent American obligations to run thosr Indians into the ground with your worldly views.
If you had not played the tourney would that increase your likelihood of winning?
It's a shame that hey didn't at least offer some beads in trade. On the bright side, they didn't give you any blankets.
