Which part? He didn't physically sell the drugs himself he provided the platform for others to do it taking a commission and giving advice on how to get around being caught. This went on for a few years with the feds knowing about it so it was quite a while before they brought him down.
The whole thing about him allegedly having people murdered isn't proven yet either just that he looked into hiring a hit man who he may or may not have paid and who may or may not have ripped him off.
As for the sellers on Silk Road I'm sure many can easily get rid of their merchandise in other ways but the wise thing now would probably be to gtfo of the country if Tor's security is in fact breached.
