To be fair, he was deliberate in downplaying it as a currency. He even said "some nerds out there are calling it money".
If anyone is converting bitcoins and using it to buy things, its currency. Just because you downplay it does not mean you are not culpable.
Why the fuck would anyone test the Feds? They crushed a lot of people in online poker, to the tune of jail. You think they are just asleep at the wheel not knowing about bitcoins and Seals? Fuck, after Black Friday you'd have thought people would have learned their lesson. When the Feds move, they will move quickly and it will be over.
