The focus is more upon what they'll be doing (and not be doing) going forward, and you have to really look at it closely to pick out the parts indicating that he didn't hold the money. It wasn't even stated clearly enough to ever be used as a legal defense.
To me this looks like they were making it clear to the NGC and other law enforcement bodies reading it that:
1) They are paying people out, and this wasn't a scam
2) Everyone but Micon is closing shop immediately and won't be offering any more bitcoin gambling, nor will they be supporting Micon's new venture in any way
So that release mainly looks like something they put out to mitigate their own damages. Since they control sealswithclubs.eu (and always have, apparently), I don't even think Micon had a choice about what they wrote. Not saying he did or didn't approve the statement (I don't know), but I'm pretty sure they were adamant about getting those two important points out there.

They actually did come back up for a few hours after the initial outage. Given what hdev was saying in lobby chat when they came up and when he announced he was taking it back down, it seems like they actually thought it was a hardware problem at first. I don't really know what to make of the few days after they went down, they were talking about stuff being back on twitter but also put up a cashout form and the wording on the website made it seem like they might not be coming up.

Nitrogen Sports is operating in Costa Rica exclusively with anon BTC transactions offering all sorts of gaming including poker. Owners and operators are largely anonymous. I've only seen one guy's name attached to the operation. All players are anonymous. Seems like there's no issues there with any of the other gaming issues brought up by operating in Antigua.

he's admitting that he's now the sole owner of seals with clubs, that it will be up and running within days and that he's basically living in antigua.
he's mistaken if he thinks that the fact that the server is physically located in romania will be enough to exempt him from getting an antiguan gaming license. a hell of a lot more goes into the analysis than just the physical location of the server. like if all your key employees (i.e. micon) are in antigua, antigua will surely take the position that the business is operating and must be licensed there. the fact that seals with clubs is not licensed in romania or any other jurisdiction makes his argument look even more ridiculous.
micon's basically admitting that he wants to use antigua to shelter him from the US, yet he's not giving antigua anything in return. just fucking idiotic.
This is going to end incredibly badly for him. I feel pretty awful for his wife and kid.

Best case scenario is that Antigua more or less has mercy on him and lets him stay in their shithole country for god knows how long. The problem is that if his new bitcoin poker site doesnt work out he is fucked. Only he knows what is on those computers that were seized, but even he seems to think he is going to be charged.

Indeed very flawed rationalizing logic. The law may come after him for making these types of statements just to have a case showing on the books that bitcoins cannot be used as a form of circumvention. People trying to evade laws would be charged with the Micon swc bitcoin statute.
It seems even worse than that. He seems to think you can provide ANY goods and services (even if the goods and services are illegal) and as long as you use bitcoin as the "currency" for the transaction the goods or services be cant classified as illegal.
The stupidity in this thinking runs so deep it is honestly hard to believe.
The whole concept of Bitcoin not being valued is hilarious. The follow up question should always be "how do you get Bitcoin?" When the answer is you buy it with money, then obviously it's a valued currency

Just because it's interesting: Canada actually did put down some laws regarding gambling of cryptocurrency. This caused the owner of just-dice to close down for some months, only to (as far as anyone can tell) legally come back up using a different one (CLAMS instead of Bitcoin) because there were no exchanges trading CLAMS for official currency. Not that that has anything to do with Micon or Seals, but I thought it was interesting that a vagueness in laws created wiggle room for them. It's pretty clear that the pachinco model doesn't fly in Nevada, but I've heard of bars in some states playing poker for a buy-in then awarding stuffed animals or some shit that they trade back for money.
It's silly to think bitcoin makes gambling fly in the states, some states have laws that outlaw any gambling with something of value, not just dollars. Maybe you can play poker for ham sandwiches in some states, but in others even play money is illegal if there is any value attached. Value being such a wide term that even a leaderboard of winners that provides personal bragging satisfaction could constitute "value." Most states also have laws against giving drugs to someone else, regardless of the number of ham sandwiches that are involved in the transaction.
Obviously none of this has fuck-all to do with this thread, it just made me get sad about the fact that we can't just play poker and be treated like reasonable, consenting, human beings in this country. The comparison, on a poker forum no less, to people that conspired to distribute drugs and have people murdered further depresses my hopes that some day we'll wake up to poker being treated like the game that it is.
