A separate "remedy" ruling by the same judge ordered the NYPD to implement reforms, including an independent oversight committee. The NYPD appealed that ruling, and was granted a motion to stay pending appeal. But then a couple months later Bill de Blasio was elected, having run on a platform that included implementing pretty much what was in that remedy ruling. So the city withdrew their appeal and the motion to stay became moot.
As of right now, Trump's proposal is unconstitutional. Any lawsuit based on a similar policy can cite the NYPD ruling as precedent and they'll win.
So one of 3 things is true-
Trump doesn't know that stop and frisk was ruled unconstitutional. Making him badly uninformed.
Trump knows and assumes that his idiot supporters don't know, having no plans to actually do anything about it.
Trump knows and doesn't think the Judicial Branch should be able to restrict the Executive Branch.
