    Prisoner in van said Freddie Gray was ‘trying to injure himself,’ document says

    BALTIMORE — A prisoner sharing a police transport van with Freddie Gray told investigators that he could hear Gray “banging against the walls” of the vehicle and believed that he “was intentionally trying to injure himself,” according to a police document obtained by The Washington Post.

    The prisoner, who is currently in jail, was separated from Gray by a metal partition and could not see him. His statement is contained in an application for a search warrant, which is sealed by the court. The Post was given the document under the condition that the prisoner not be named because the person who provided it feared for the inmate’s safety.

    The document, written by a Baltimore police investigator, offers the first glimpse of what might have happened inside the van. It is not clear whether any additional evidence backs up the prisoner’s version, which is just one piece of a much larger probe.

    Gray was found unconscious in the wagon when it arrived at a police station on April 12. The 25-year-old had suffered a spinal injury and died a week later, touching off waves of protests across Baltimore, capped by a riot Monday in which hundreds of angry residents torched buildings, looted stores and pelted police officers with rocks.

    Police have said they do not know whether Gray was injured during the arrest or during his 30-minute ride in the van. Local police and the U.S. Justice Department both have launched investigations of Gray’s death.

    Jason Downs, one of the attorneys for the Gray family, said the family had not been told of the prisoner’s comments to investigators.

    “We disagree with any implication that Freddie Gray severed his own spinal cord,” Downs said. “We question the accuracy of the police reports we’ve seen thus far, including the police report that says Mr. Gray was arrested without force or incident.”

    Baltimore police said they will wrap up their investigation Friday and turn the results over to the Baltimore state’s attorney’s office, which will decide whether to seek an indictment. Six police officers, including a lieutenant and a sergeant, have been suspended.

    Capt. Eric Kowalczyk, chief spokesman for the Baltimore Police Department, declined to comment on the affidavit, citing the ongoing investigation.

    The affidavit is part of a search warrant seeking the seizure of the uniform worn by one of the officers involved in Gray’s arrest or transport. It does not say how many officers were in the van, whether any reported that they heard banging or whether they would have been able to help Gray if he was seeking to injure himself. Police have mentioned only two prisoners in the van.

    Baltimore Police Commissioner Anthony W. Batts has admitted flaws in the way officers handled Gray after they chased him through a West Baltimore housing project and arrested him. They said they later found a switchblade clipped to the inside of his pants. Batts has said officers repeatedly ignored Gray’s pleas for medical help and failed to secure him with a safety belt or harness in the back of the transport van.

    Video shot by several bystanders has fueled the rage in West Baltimore. It shows two officers on top of Gray, their knees in his back, and then dragging his seemingly limp body to the van as he cried out.

    The van driver stopped three times while transporting Gray to a booking center, the first to put him in leg irons. Batts said the officer driving the van described Gray as “irate.” The search warrant application says Gray “continued to be combative in the police wagon.”

    The driver made a second stop, five minutes later, and asked an officer to help check on Gray. At that stop, police have said the van driver found Gray on the floor of the van and put him back on the seat, still without restraints. Police said Gray asked for medical help at that point.

    The third stop was to put the other prisoner — a 38-year-old man accused of violating a protective order — into the van. The van was then driven six blocks to the Western District station. Gray was taken from there to a hospital, where he died April 19.

    The prisoner, who is in jail, could not be reached for comment. No one answered the phone at his house, and an attorney was not listed in court records.

    Batts has said officers violated policy by failing to properly restrain Gray. But the president of the Baltimore police union noted that the policy mandating seat belts took effect April 3 and was e-mailed to officers as part of a package of five policy changes on April 9, three days before Gray was arrested.

    Gene Ryan, the police union president, said many officers aren’t reading the new policies – updated to meet new national standards – because they think they’re the same rules they already know, with only cosmetic changes. The updates are supposed to be read out during pre-shift meetings.

    The previous policy was written in 1997, when the department used smaller, boxier wagons that officers called “ice cream trucks.” They originally had a metal bar that prisoners had to hold during the ride. Seat belts were added later, but the policy left their use discretionary.

    Ryan said that until all facts become clear, he “urged everyone not to rush to judgment. The facts as presented will speak for themselves. I just wish everyone would take a step back and a deep breath, and let the investigation unfold.”

    The search warrant application says that detectives at the time did not know where the officer’s uniform was located and that they wanted his department-issued long-sleeve shirts, pants and black boots or shoes. The document says investigators think that Gray’s DNA might be found on the officer’s clothes.

    Obviously this guy could have been coerced into giving this testimony, it's pretty hard to imagine someone severing their own spine, but who the fuck knows. It just adds another dimension to this that hasn't really been talked about. I can't even imagine what the outcome will be if they find the police were not at fault here, which given the long standing history of hardly ever finding cops guilty in these situations, is almost inevitable.

    Obviously this guy could have been coerced into giving this testimony, it's pretty hard to imaging someone severing their own spine, but who the fuck knows. It just adds another dimension to this that hasn't really been talked about. I can't even imagine what the outcome will be if they find the police were not at fault here, which given the long standing history of hardly ever finding cops guilty in these situations, is almost inevitable.

    I read somewhere that Freddie was hit by a car and had surgery on his spine recently.

    I have no idea what is true or not at this point.
    Just because you can doesn't always mean you should.

    The probe into Freddie Gray’s death found no evidence that his fatal spinal cord injuries were caused during the arrest, which was videotaped, ABC7​ WJLA reported, citing multiple sources.

    The sources had been briefed on the findings of a police report turned over to prosecutors on Thursday as well as preliminary findings made by the medical examiner’s office.

    Sources said the medical examiner found Gray’s catastrophic injury was caused when he slammed into the back of the police transport van, apparently breaking his neck; a head injury he sustained matches a bolt in the back of the van, the station reported.

    Details surrounding exactly what caused Gray to slam into the back of the van was unclear. The officer driving the van has yet to give a statement to authorities.
    It’s also unclear whether Gray’s head injury was voluntary or was a result of some other action.

    this entire situation, from the mismanagement at the Mayoral level down, stinks.

    those officers should be punished, and hopefully this will lead to some major changes.

    at the same time, I hate how this became a RACE issue again. The person had a ton of prior arrests, he was likely doing something wrong and ran because of it (or his priors), and even the word THUG is now racist.

    Feelings from a Police Officer....

    Today, I stopped caring about my fellow man. I stopped caring about my community, my neighbors, and those I serve. I stopped caring today because a once noble profession has become despised, hated, distrusted, and mostly unwanted.
    I stopped caring today because parents refuse to teach their kids right from wrong and blame us when they are caught breaking the law. I stopped caring today because parents tell their little kids to be good or “the police will take you away” embedding a fear from year one. Moms hate us in their schools because we frighten them and remind them of the evil that lurks in the world.

    They would rather we stay unseen, but close by if needed, but readily available to “fix their kid.” I stopped caring today because we work to keep our streets safe from mayhem in the form of reckless, drunk, high, or speeding drivers, only to be hated for it, yet hated even more because we didn’t catch the drunk before he killed someone they may know.

    Nevertheless, we are just another tool used by government to generate “revenue.” I stopped caring today because Liberals hate the police as we carry guns, scare kids, and take away their drugs. We always kill innocent people with unjust violence. We are called bullies for using a Taser during a fight, but are condemned further for not first tasing the guy who pulls a gun on us.

    And if we do have to shoot, we are asked “why didn’t you just shoot the gun out of their hand?” And when one of us is killed by the countless attacks that do happen (but are rarely reported in the mainstream media) the haters say, “Its just part of the job.” I stopped caring today because Conservatives hate us as we are “the Government.” We try to take away their guns, freedoms, and liberty at every turn.
    We represent a “Police State” where “jackbooted badge-wearing thugs” randomly attack innocent people without cause or concern for constitutional rights. We are Waco, Ruby Ridge, and Rodney King all rolled into one lone police officer stopping to help change an old lady’s tire. I stopped caring today as no one wants us around, but instantly demands answers, results, arrests, when a crime takes place.
    If a crime isn’t solved within the allocated 60 minutes it takes CSI on television, we are inept, incompetent, or covering something up. If we do get “lucky” it was just that and everyone with a Facebook account can post wonderful comments of how “they” would solve the case and how “we” are not nearly as clever.

    I stopped caring today because a video of a cop six states away, from a department that you never heard of, screws up and forgets his oath of honor, thus firing up an internet lynch-mob of cop haters even though 99% of us work twice as hard not to end up in the news and to still be “the good guys.” We are “militarized” because we wear body armor and kevlar helmets when shots are fired or rocks thrown at us and carry scary looking rifles even though everyone knows that they are easier to shoot and are more accurate than a handgun or a shotgun.
    I stopped caring today because the culture of today’s instantly connected youth is only there to take and never give back. To never accept responsibility for ones actions, but to blame everyone else instead of themselves. To ask “what is in it for me?” versus “what can I do for you?”

    To idolize gangsters, thugs, sexually promiscuous behavior, and criminals over hard work, dedication, and achievement. To argue that getting stoned should be a right, yet getting a job or an education is a hassle. To steal vs. earn. To hate versus help. Yes, I stopped caring today. But tomorrow, I will put my uniform back on and I will care again.

I stopped caring today as no one wants us around, but instantly demands answers, results, arrests, when a crime takes place.
    If a crime isn’t solved within the allocated 60 minutes it takes CSI on television, we are inept, incompetent, or covering something up. If we do get “lucky” it was just that and everyone with a Facebook account can post wonderful comments of how “they” would solve the case and how “we” are not nearly as clever.

    I stopped caring today because a video of a cop six states away, from a department that you never heard of, screws up and forgets his oath of honor, thus firing up an internet lynch-mob of cop haters even though 99% of us work twice as hard not to end up in the news and to still be “the good guys.” We are “militarized” because we wear body armor and kevlar helmets when shots are fired or rocks thrown at us and carry scary looking rifles even though everyone knows that they are easier to shoot and are more accurate than a handgun or a shotgun.
    I stopped caring today because the culture of today’s instantly connected youth is only there to take and never give back. To never accept responsibility for ones actions, but to blame everyone else instead of themselves. To ask “what is in it for me?” versus “what can I do for you?”

    To idolize gangsters, thugs, sexually promiscuous behavior, and criminals over hard work, dedication, and achievement. To argue that getting stoned should be a right, yet getting a job or an education is a hassle. To steal vs. earn. To hate versus help. Yes, I stopped caring today. But tomorrow, I will put my uniform back on and I will care again.

    And if we do have to shoot, we are asked “why didn’t you just shoot the gun out of their hand?” And when one of us is killed by the countless attacks that do happen (but are rarely reported in the mainstream media) the haters say, “Its just part of the job.” I stopped caring today because Conservatives hate us as we are “the Government.” We try to take away their guns, freedoms, and liberty at every turn.

    it turns out that the Baltimore State's attorney, Marilyn Mosby, is politically connected to the Attorney for the Gray family. He was her largest donator to her campaign.

    One of the Baltimore police officers who arrested Freddie Gray wants the police department and prosecutor to produce a knife that was the reason for the arrest, saying in court papers that it is an illegal weapon.
    The city's top prosecutor, Marilyn Mosby, said Friday in charging the officer and five others that the knife was legal under Maryland law, meaning they had arrested Gray illegally.


    The motion was filed Monday by attorneys for Officer Edward Nero in Baltimore District Court.
    Nero is charged with second-degree assault, misconduct in office and false imprisonment — charges that can only be proven if Gray was wrongly arrested, said Andy Alperstein, a Baltimore attorney who has represented police officers but is not involved in the Gray case. If the knife was illegal, "there is no case" against Nero and another officer, he said.




    "If the facts were that the knife was illegal then the Gray arrest would be justified. Even if it wasn't illegal and the officers acted in good faith, it would be the same result. All charges fail," Alperstein said.
    Marc Zayon, Nero's attorney, argues in his motion that the knife in Gray's pocket — described in charging documents as "a spring assisted, one hand operated knife" — is illegal under both Baltimore's switchblade ordinance and state law. Gray was charged under the city ordinance, which has a different definition than the state law of what constitutes a switchblade.
