Before anyone argues that life in prison is worse than death, keep in mind that this is much easier to say when you're sitting on the outside, and not facing a potential death sentence yourself. Nearly every death-penalty-eligible criminal attempts to fight it, with some actually pleading guilty and taking life without parole, simply to get the death penalty off the table. A small percentage prefer the death penalty, usually those who feel guilty about their crimes and feel they deserve death. Tsarnaev does not feel guilty, nor did he want to be killed. He clearly was trying to escape once identified and being pursued, and didn't attempt "suicide by cop" at that point.

Even if Dzhokhar Tsarnaev is sentenced to death, he is being charged in federal court which almost never executes anyone.

The last person who was excuted in the federal system was Timothy Mcveigh who was only excuted because he drop all of his appeals.

Tsarnaev is more likely to die of old age than by execution.

If this happened in Utah, he might face death by firing squad.
