YES, you can always deduct cash game losses from cash game wins which occur in the same calendar year. Jamie implied that you can't do that.

NO, you don't need receipts or proof of your losses. Obviously the more verifiable information you have, the easier it is, but for the most part, they usually take your word for it if there isn't a paper trail (or evidence) contradicting your claims. They may put you through the wringer in an attempt to prove that you're lying, but if everything you say and show adds up, you typically won't have a tax problem.

The amount of money you claim to have "lost back" also plays into the picture. If you win $1500 in a tournament and claim to have lost it back in cash games, the IRS will always believe you, as that's very easy to do. If you won a $3 million tournament and claim to have lost it all at cash games, the IRS will want to know a lot more, such as who was in the games, the dates you played, who won, etc. They might interview others in order to validate your stories, check bank/casino records, etc. But if you're telling the truth, you will typically come out okay.

Here's what I think happened to Jamie Gold:

I am guessing he didn't pay taxes on his monster 2006 win, and then degened the money off in subsequent years. According to the IRS, you still owe taxes in this situation, as you can only deduct losses from wins if they occurred in the same calendar year.

Thus, if you won $1 million on December 31, and then shot it all off on January 1, you would still owe the taxes on that $1 million win.

Shift the whole thing back a day -- winning a million on December 30 and shooting it off on December 31 -- and you owe no taxes.

So I think Jamie shot off everything in later years, and now the IRS is coming after him for the taxes he didn't pay in 2006. That's my theory.
