    Filing Chapter 7 BK these days...

    I know they supposedly toughened the laws on people filing chapter 7's, but is it really any harder to just file personal bankruptcy if you have serious debt due to unforeseen life circumstances?

    I'm asking for my boy that is now 40k in the hole because of his crazy baby momma, he is thinking about filing for bankruptcy to get rid of the debt. He doesn't make that much money and will never be able to dig out of that hole.

    I filed once for Chapter 7 many moons ago, and it was ridiculously easy to just wipe the slate clean.

    What type of debt? If it's education related you own it till you die. In fact if you have education debt and your parents co-sign and you drop dead they are on the hook.

    If it's credit cards and other revolving debt you can work around it.

    The first two bills passed in 2001 by the Republican Congress were slashing Capital Gains taxes and making it much harder to discharge debts in personal bankruptcy.

    Ok, let's stipulate that you wanted to present a fact about declaring bankruptcy. Why did you have to throw in the jab about the GOP cutting capital gains taxes? In what way is that germane to a discussion about Chapter 7 filings? You should look into taking your passive aggressive bullshit somewhere that it can be fully appreciated.

    As far as the cars go it sounds like that's not much of a problem from a debit standpoint if they are above water. That said if the CC and other expenses are high and they are carrying big car payments perhaps they should sell and downsize.

    As far as the credit cards if they are willing to commit to turning it around they can negotiate with the card companies and get on a payment plan. Of course this only works if your willing to tear up the cards and not use credit to finance your life. The card company will take something over nothing.

    Edit - sounds like its all for not if "the baby mama" isn't on board with getting serious about the debt problem.

    I know a guy who filed since 2001 and it sounded real easy.
    He had a very badly timed divorce, 4 foreclosures on 2 properties, (about 900k total debt) plus another 60k unsecured, erased in BK7, 5 years later and he has a 707 FICO.

    I mean F, Warren Sapp Filed and he makes over a million a year.
    Blitz'd dad filed and look at his son.

    I think the system is still pretty easy.

    Its interesting you say that because someone very close to me just looked into filing but they said she made too much money (low six figures). Maybe the problem was she had no debt. Imagine that, somebody with no debt looking to file bankruptcy while making over a hundred a year. What do you think the issue was? You seem to be in the business. I know by the way.
