Wow, crazy story. I can't believe the law would support this.
They may have been free rolling the employee for 4k, knowing the employee values this job where he makes good tips. Knowing there was a good chance he would pay it. If he decided not to pay it, they almost had to have known he would get a lawyer if terminated. They could have gave the employee a "Were just kidding, we wouldn't fire you". Or management decided we "value you, you can keep your job". They get a free chance to collect and if employee says he's not paying, they say we're JUST KIDDING!... What scumbags!
But publicity is just about the worst thing for the business. Definitely backfired on them!
