There is no way the people who used that erroneous freeroll play believed that they legitimately deserved to receive it. As such, by using it to play with, they were commiting theft. This is no different than if an ATM mistakenly spits out more money than is in your account and you walk away with it. I’m wondering how the Indian reservation would handle this re their criminal code.
People love to use the ATM example whenever this type of thing comes up, but it doesn't necessarily apply.
ATMs are straightforward. If you request $40 and get $400, you know you requested $40, and got 10x that amount.
With casino freeplay, one could use the defense that they simply didn't know what they were expecting, and simply showed up to the kiosk to check. Should it be up to the player to sanity check it? I'm not sure. For 10x the amount, definitely not. For 100x... well, that's a tougher one.
Indian casinos in CA aren't even required to publish their return to player % as far as I know. I would take them for every penny I could.
