Sahara takes VitalVegas to task for saying they're going to close

    https://twitter.com/SAHARALasVegas/status/1288961644614148096

Vital Vegas has been known to act irresponsibly at times, tweeting out lots of false rumors without doing any kind of sanity check. Sometimes they're correct and calls something before it happens, but they're also wrong a whole lot.

Have no idea if he’s right or not but there’s no way a casino would admit to it if they were on the verge of closing anyway.

Considering his reach, do you think he has an obligation to confirm that before tweeting?

I can’t see how a whole bunch of casinos don’t close for good as it looks like our government will not allow things to return to normal anytime soon. Vegas just cannot survive as it has in this global environment.

If he could confirm it, he wouldn't label it as a "rumor."

The last thing I'm gonna do is debate what's "responsible" to post on twitter, and if I was gonna, I wouldn't start with a rumor about a casino closing.

Lotta things killing the casinos right now. That tweet is not one of them.
LOL. Join the conversation willingly and then complain about even being in such a stupid conversation. Finish by stating your opinion on said conversation that’s not worth discussing.

    Welcome to 2020.

This has not been publicized, but Sahara is currently suing VitalVegas (aka Scott Roeben) for the false rumor.

    Here's the filing: https://ewscripps.brightspotcdn.com/...as-lawsuit.pdf

They're only asking for $15k + punitive damages, which is surprising. I'd think they could demand more.

This doesn't seem frivolous. According to the lawsuit, they attempted to correct him, but he kept doubling down on the original claim, and kept asserting in various ways (directly and indirectly) that the closure was coming.

    Ouch.

Mr. Roeben retained Marc Randazza as an attorney against the Sahara suit, who is well respected. Randazza is a known First Amendment lawyer, and has appeared on CNN.

I was sent a copy of Randazza's anti-SLAPP filing on Roeben's behalf. Some more info came out, and now I think it's actually looking fairly good for Roeben to beat this.

The strongest piece of evidence in Roeben's favor is that a source at a liquidation firm had told Roeben in July that Sahara had contacted them about liquidating the entire property.

The filing also claims that Sahara is a "public figure", and thus the burden of proof here is "actual malice", which requires that Roeben would have had to know his claims were false at the time he made them. Since it's clear that Roeben thought the rumors were accurate, Sahara definitely can't prove that.

An attorney I know in Las Vegas told me that he agrees with my assessment that Roeben is looking fairly good here, especially given that Nevada has been leaning in general in recent years toward granting anti-SLAPP motions.''

"Melissa Vegas", whose real name I know but will be nice enough not to make public, is/was Scott Roeben's girlfriend.

She posted on April 1 that there's a lot more to this case in the past 6 months than people think. It was presumed that this was done in October, when Roeben won the anti-SLAPP. Peter Binklage did post a month ago that there was an appeal to the Nevada Supreme Court, which got dismissed, but apparently there's more action since then.

I'm surprised Sahara is so dedicated to this. Usually large corporate entities don't pursue individuals this hard.

I'm in the process of looking for these legal documents.

Oh, and Melissa has an OnlyFans page now.

    She's 38, and I believe Scott is 57.

As always, we deliver the goods.

    Cliffs:

    - VitalVegas won Anti-SLAPP

    - Sahara tried to file both an opposition to attorney's fees AND and appeal, but the appeal was filed after the deadline of November 29

    - Sahara tried to take appeal to Nevada Supreme Court. After some legal wrangling back and forth regarding jurisdiction, indeed the Supreme Court dismissed it for lack of jurisdiction

    - VitalVegas was granted fees of $94k or so, which rose to $96,633 by the time when it was paid on March 4, likely due to interest

    - On April 1, notice was filed by VitalVegas that the judgment was satisfied, and the case is over. It was formally closed on April 6.

Details on what happened in both Clark County District Court and Nevada Supreme Court since October 2020:

    DISTRICT COURT
10/20/20: Court (Judge Atkin) grants Anti-SLAPP Motion to Dismiss
10/30/20: Court enters written order granting anti-SLAPP
    11/12/20: VitalVegas files Fees Motion
11/25/20: Sahara files opposition to Fees Motion
12/8/20: VitalVegas files reply in support of Fees Motion
12/9/20: Sahara files notice of appeal (note: deadline to do so was 30 days after entry of written order, i.e. 11/29/20)
12/14/20: The day before the hearing on the Fees Motion, Sahara files notice of association of counsel that they've hired Daniel Polsenberg and Abraham Smith, of Lewis Roca Rotherberger Christie (LRRC) on this matter. However, it turns out LRRC is Marc Randazza's firm for his professional responsibility matters, creating a (potential) conflict of interest.
12/15/20: Hearing on Fees Motion continued to address conflict issue.
12/22/20: Court decides not to have a hearing on the Fees Motion and instead to make a ruling on the papers submitted.
12/30/20: Court enters order granting Fees Motion in full for $94k or so.
1/4/21: Case reassigned to Judge Barisich.
1/20/21: Sahara files Amended Notice of Appeal
1/27/21: Sahara files Motion to Amend Judgment.
2/2/21: VitalVegas files Motion to Disqualify LRRC.
2/2/21: VitalVegas files writ of execution for the $93k + interest.
2/7/21: VitalVegas files Motion to Stay Plaintiff's Motion to Alter or Amend the Judgment on Order Shortening Time
2/10/21: Sahara files opposition to Motion to Stay.
2/17/21: Parties stipulate to stay matter in district court pending outcome of appeal.
3/31/21: District court receives remittitur from Supreme Court.
4/1/21: Parties file Joint Notice of Satisfaction and Judgment
4/6/21: Parties formally close the case.

    SUPREME COURT
12/15/20: Case is opened at Supreme Court.
12/15/20: VitalVegas moves to dismiss for lack of jurisdiction.
12/15/20: Case is referred to settlement program.
12/16/20: Motion denied by clerk because case has been referred to settlement program.
    12/16/20: VitalVegas moves to reconsider
12/23/20: Court grants motion to reconsider and issues order to show cause, giving Sahara 14 days to show cause why the appeal should not be dismissed for lack of jurisdiction.
1/6/21: Sahara files motion to extend time to respond.
1/7/21: VitalVegas opposes motion to extend time.
1/14/21: Sahara replies in support of motion to extend time.
1/29/21: Court grants Sahara's motion to extend time to respond.
2/8/21: Sahara files response to order to show cause.
2/9/21: Randazza files reply in support motion to dismiss for lack of jurisdiction.
3/4/21: Supreme Court orders appeal dismissed for lack of jurisdiction.
3/29/21: Remittiur issue and case closed.
