This is a definition of a professional gambler -
A professional gambler, by definition, is someone who makes a living off of their gambling winnings.
Professional gamblers have their primary game of choice, which could be sports betting, poker, or blackjack.
It seems to me that Chrissy's disclaimer is not valid. His disclaimer states that he is a professional gambler and entrepreneur. It doesn't matter that the disclaimer states that a person(s) cannot hold him liable for their losses if he lied about his credentials in the disclaimer.
If he were sued for fraud, he would have to document and prove to the court that he makes at least part of his living as a professional gambler. He would not be able to substantiate that.
The person who claimed they were scammed and defrauded by Chrissy's could show the court numerous pictures of Chrissy holding up his Amazon fake prop money. The person could provide pictures showing that he placed a hundred dollar bill on top of each stack of one dollar bills to deceive his viewers. These deceptive tactics are what convinced his desperate rubes to sign up and pay him unaffordable sums of money.
A person could document that Chrissy made scores of videos where he played roulette and blackjack on Betonline and that he encouraged his viewers to click on his affiliate link and start playing and winning like him. It could be documented that Chrissy is an afilliate of Betonline and that his sole intent was to be paid a commission from Betonline for the losses incurred by his viewers.
I am not sure that it would be possible to subpoena Chrissy's tax returns. If he even filed returns, there would be no gambling income or gambling losses noted. The casinos could provide documentation of Chrissy's wins and losses and we all know what those records would look like.
All of these actions could prove that Chrissy is not a professional gambler and defrauded his chums.
I doubt that any of his chums would consider suing Chrissy in small claims court but I would love to see it happen.
To recap, Christopher Mitchell is NOT a professional gambler because he does not make any part of his living winning money by gambling in casinos.
Do we have a lawyer that frequents PFA? It would be interesting to hear his or her's opinion.
