Seen this happen so often and it busted me countless times, rewind the video to the point where the dozens hit 4+ times in a row, none of that was natural movement... Without a doubt theY cheat but they only activate the magnets at certain strategic times. The issue of Chrissy and his taxes can be a fairly large issues.

I agree that the IRS can’t get anything out of someone that doesn’t have any cash, and in the US we don’t have “debtors prison”.

As probably everyone here is aware, an individual can write off their gambling losses UP TO the amount of gambling winnings.

For example:
Someone wins a $50,000 slot jackpot gambling.
During that same calendar year they lose $70,000 taking weekly trips to the casino. Out of that 70k, they can only write off 50k. That extra 20k that was lost does not get to be written off.

Now, to what Druff brought up. As a “business”, you can write off expenses that you incur as a business if you are in the “Gambling and Consulting” space.

Example:
In a small retail clothing store their largest expense would be clothing purchased at wholesale cost, then normal expenses such as labor, building lease ect. This clothing store may bring in $500k annually, but may have $410k in total expenses, which gives it a $90k net profit in which the owner of the store must pay taxes on.

Let’s look at Chrissy’s “gambling and consulting” business. Any expenses that Chrissy incurs as part of running his business can be deducted from his overall income, that number becomes his Net Income in which he must pay taxes on. Just like the retail clothing store there will be “expenses”, but I will explain why I believe his gambling losses are not a business expenses. If you look at a slot channel like “Slot Lady”. She is playing for one purpose and that is to post her play on YouTube, which will in turn generate ad revenue. There is a clear link between the gambling and her business.

When Chrissy is gambling at the brick and mortar casinos, he is presumably:
1. Not recording his play
2. Playing By himself (Not with a client)
3. Most likely is not keeping accurate W/L records.

I believe these three things would disqualify his gambling losses as a “business expense”.

I am not a CPA, but from my mild understanding of tax laws, he should NOT be allowed to write this off as a business expense - since his gambling has nothing to do with the business itself, other than simply sharing the name “gambling”. These slot channels on the other hand, it is necessary for them to deduct losses as an expense as it is critical to their production, and without the YouTube production they would otherwise NOT be gambling. Chrissy on the other hand, if you had a way to physically restrain him from gambling - his income would be the same, therefore his own gambling is not needed as part of the operation, therefore she not be a deductible expense. With Slot Lady - you end her gambling, she will have no business.

With Chrissy, he would be disguising his gambling addiction as a legitimate business expense.
There is no doubt in my mind, if Chrissy is by chance filing taxes he is writing off these massive losses. He will also most likely get an audit if he is doing this by the simple fact he is “deducting” 80% or more of his gambling losses as a business expense.

He would likely do something like $360k income minus $320k in business expenses for a net profit of $40k.

The big issue I see is once he commits to the $360k income he can’t back out of it. If and WHEN he gets audited, they could determine that the $320k he is deducting is NOT an appropriate business expense. Why can they do this? BECAUSE THEY ARE THE IRS. Even if the law was on his side, it would be clear in any audit what he is doing and they could rule, then make him appeal it.

This is what I think will happen:
In the next 1 to 3 years he will be audited. The audit will determine that deducting his losses are not a qualifying expense since his gambling is not a direct part of the business operation, other than in name only, and is more of a hobby that is loosely connected to his business by category and the results of his gambling are not connected to the actual business itself. At that point I think they take away the “expenses” (losses) that he deducted and then has a huge tax bill. At this point he will be forced to appeal it. Personally, I just can’t see enough of a connection where that deduction would be appropriate.

Another thing, when deducting “gambling losses” the record keeping requirement is fairly loose. When it becomes a “business expense” the proof needed is a much higher standard (receipts).

This would be similar to a professional poker player that gives coaching on the side. Let’s say this coach has a -EV slot machine addiction. If the law would allow him to deduct slot losses because his category is “Gambling consultants”, this would be a huge problem with our tax system.

Also, Chrissy’s big mistake was using Thrive Cart. He did it because he is greedy and he knows he wouldn’t make anywhere near as much only accepting Bitcoin. With Thrive Cart the money is reported, that money is withdrawn straight into his bank account which creates a second record of it.

As far as the “Business expense deduction”, There is a line drawn someone, where that exact line is, I’m not exactly sure, but I would have to believe Chrissy has far exceeded it.
