I'll be on radio tonight fellas. Explaining my court dealings with CM.

I listened the interview...but one thing sticks out. Why didn't you or your attorney just show that you aren't Kevin Davis (or whatever the guy's name is who has been posting about the scammer)? All you had to do is to show who is the operator of the site, and where it is originated from. The "Not me" defense works every time when you can show who actually is doing the conduct Mitchell was complaining about. Back when I was litigating, it worked every time I used it. Also, your attorney saying you "made a mistake" was a huge mistake. You didn't make the mistake...Kevin Davis did.

Druff was correct in his assessment of the appellate process. And all you had to show was that there was no evidence presented at the original hearing to prevail. But, the Judge knew it was never going to get to that stage and just did as he pleased. The Judge was probably thinking the whole thing didn't pass the smell test. And, he may be correct. There are things you aren't telling us about the whole thing.

I guess I'm confused as to how I prove I am not someone that is simply a voice on a YouTube channel?

Thr voices are clearly different, but the judge had no interest in hearing some random Youtube content as "proof" that I'm not someone.

The judge 100% believes his clerk that she heard yhe courtroom on the YT channel, even though she didn't.

I understand and respect those who have practiced law giving input. However, they never sat in a courtroom in Las Vegas, with Christopher Mitchell as the complainant for Christ’s sake and sitting before a Judge that made the ruling he did. Talk about a surreal experience.

You could have researched the origin and ownership of the YouTube Channel and shown the Judge that the owner is someone else, somewhere else. Anything else would be irrelevant, including what the clerk heard. Mitchell was trying to obtain a restraining order based on past conduct. If you can show that you are not the owner or originator, then he can't meet his burden of proof to obtain said Order. I understand that you are not an attorney and didn't realize what you needed to do in the first hearing. Your attorney should have brought this up in the second hearing and harped on the issue that it is a case of mistaken identity.

I never said there weren't unsavory details either. There are just missing details. Tell me, you don't wonder about how many coincidences occurred in his story? Like the timing of the videoposting while he was in court? You don't think the Judge thought there might have been some coordination between AHoosierA and Kevin Davis? If you're insinuating that I'm in some kind of cohorts with KD you're wrong. I've not had any contact with him since May 27th. He's tried reaching out to me several times but I have no desire to talk to him. My court date was scheduled on on 6/3/2020 @ 8:55am. My hearing didn't start until sometime around 9:15ish if I remember correctly. KD's video was 3 minutes and 20 seconds long. If I were in cohorts with KD, I would have asked him to stay on longer so the judge could hear his voice. From my understanding, recording the court proceedings with out permission is against the rules of the court and possibly against the law. I would never put my career in jeopardy over this clown, so I would never even attempt to record the court proceedings. My wife has never been involved with any of this either, and quite frankly, this had put an unnecessary strain on our relationship for some time while this was all going on.

I had done some research, albeit very minimal, as far as getting with YouTube and finding out who the channel belongs to but from my understanding that would require a subpoena. I should have done more research and studied more on how to do that prior to my first court appearance but I was pretty ignorant. In the end though I felt it wasn't important as I felt at my first hearing I didn't have to defend that I wasn't KD, but that CM had to prove that I was...and there was and is no proof that I am part of that channel.

Moving forward if anything else comes from this, having a subpoena from YT is something I'll bring up to my attorney that could be some pretty damning evidence.

As far as the coincidence of having an associate attorney of the one I hired be present in the first court hearing was just sheer luck and sheer coincidence. Coming out of the courtroom I didn't know the names of anyone in the court other than the judge and CM. Coming out of the courtroom I had called several attorneys who either wanted $2k+ to represent me, or couldn't consult with me until days later. The one I finally hired agreed to meet with me that day, and it wasn't until after talking him for nearly 2 hours, that it came to light that his partner was present. Leading up to the hearing, I had not spoke with the associate "Roy" until that day in court and had no idea that he would be there or why he was there. I assume he came along because 1) he was familiar with the case, and 2) My attorney "overbooked" himself? (not sure if that's a real thing or not)

One thing I'm going to look into doing is getting the court transcripts of everything that transpired in the courtroom as they happened. I've never done this before so I'm not sure what to expect, I know it'll cost some money but I'm not worried about that and I'm interested in having them for my own personal records. Hopefully I'll be able to post those and that will clear some things up for those that have questions.

I did get one detail wrong. I thought the police report was filed on 5/18 but that appears to be when he filed for the TPO. The police report was filed on 5/12 after looking back through the documents.
