Actually... thinking more about it, this is a worrisome precedent. Technically the Senate is supposed to confirm cabinet appointments, but that's pretty much always been a formality. Trump skipped that a bunch of times by just making people "acting" cabinet members, and it was presumed that Biden might do the same. But if those appointments are now considered unlawful, then McConnel will be able to just block everything.That is funny, although it was going to get reversed in two months anyway. EDIT: Reading further into it, looks like he would have some options such as recess appointments.
