    I was one of two people selected to arbitrate an argument between Allen Kessler and Jason Bral




    Laughably, I was announced by Kessler as an arbitrator without any consultation with me as to whether or not I would do it.

    I ended up agreeing, as did the other selected arbitrator, attorney Mac Verstandig (who frequently represents poker players in legal matters, and is currently the attorney bringing the civil case against Stones Casino in the Postle matter).

    The argument is actually over a simple matter -- the definition of the word overlay.

    Allen Kessler thinks that a poker room can only claim overlay if all money collected (buyins AND fees combined) is less than the guarantee.

    Jason Bral thinks that they can claim overlay as long as the cumulative buyins are less than the guarantee, even if adding the entry fees would put it over the guarantee amount.

    Mac and I have decided to write an official-looking legal document as if this were a real arbitration case. He's the one formatting it because I'm not an attorney, but we are both writing the content together.

    It will probably be released today.

    While the bet involves real money, neither of us are being paid for our arbitration of the matter.

    Seems like an advertised guarantee is for the prize pool. The prize pool does not includes the fees that are added into the total entry fee.

    So like at the WSOP Circuit event where the buy-in is $400.00 with a $100,000 guarantee, and the structure sheet clearly says that the prize pool gets $330 and $70 is for admin fees, only $330 of the entry fee is used for the prize pool and the number of entries x $330 will determine whether or not there is an overlay.

    I know he means well but AK is getting very annoying.

    Will be interested to see what Druff and Mac come up with.

    Just an observation from a “Fish”, who got hooked....

    Most people interested in the decision will have absolutely no clue as to what half of what was written therein means. Sure, an attorney can understand the structure of the document and the legal Latin verbiage means. And, Yes, an experienced Poker player can understand the relevance and application of the Poker parlance contained within the four corners of the document. But, it takes a special type of Nerd to read the entire document, understand it, and more importantly understand that the joke was on them for taking the time to do so. Tip of the hat to you sir!
