    Former child actor Scott Schwartz claims he got ripped off by a Playboy Playmate in 2011, now he's trying to publicly shame her (update: she responds to Druff by e-mail!)

    Remember Scott Schwartz? He starred in The Toy with Richard Pryor in 1982, and then was the kid who got his tongue stuck to a flagpole in A Christmas Story.





    Well, apparently Schwartz befriended a Playboy Playmate named Audra Lynn, who appeared in Playboy in 2003.





    In 2011, Audra, whose modeling career was long in the toilet, allegedly borrowed $500 from Scott.



    He says that when she "paid him back", she put a stop on the check. Now she's blocked him on Facebook, and he finally had enough and posted this:

    I do wonder if she at least banged him prior to this loan being made, or if he was just friendzoned and hoped to get a piece of her, and then she borrowed $500 and ghosted him.

    1-what happened to the 500 stickers?
    2-did the original deal specify when/where/how the stickers when signed were to be gotten back to him?
    3-what proof is there that the stickers were signed by you?
    4-did you discuss other remedies to his not getting the stickers? such as did you offer to sign 500 more stickers rather than return the $500? return only part of the money as compensation for the opportunity cost?
    5-given that she had to leave, did she make arrangements with someone (such as the show manager/organizer) to hold the stickers until the other party returned to pick them up? (that would seem a reasonable thing to do under the circumstances).

    from the evidence provided so far, in my opinion she owes the money...there appears to have been a contract made to which there was no evidence by writing, there was fault claimed with the performance of the contract (non-delivery) and then the parties agreed/made a 2nd contract to remedy the fault in the a original contract by the return of the compensation ($500), and lastly the 2nd contract was deliberately breached (payment of 2nd agreement check stopped)..

    that there was no writing evidencing the original contract does not invalidate the original contract (not over dollar amount specified by law to require writing, not requiring more than 1 year to perform, etc). Thus, the original contract appears to be binding to the parties.

    In any contract, both parties are obligated to act reasonably and in good faith in making the contract and in performing the obligations they undertake. Here, there was a problem with delivering the signed stickers back to the other party. It should be foreseeable that the time/place of product delivery would be an issue to the contract, and without warning from the other party, the purchasing party could reasonably assume the signer would be there until the announced closing time of the show---I don't recall if she stated she had to leave early and thus could not hold the stickers. So by default, the closing time of the show and the place of the contract is reasonable delivery time/place. Leaving early without making alternative arrangements for delivery is not acting reasonably.

    I doubt there was an attorney telling her to stop the check--it sounds as if she is trying to make her position more weighty by claiming it has legal opinion backing it--so I don't give any merit to that claim. Also, I would expect a lawyer to suggest settling/compromising the dispute rather than just stiffing the other party.

    Finally, she was an adult at the time of the original contract and the subsequent remedy agreement--given that the original contract appears enforceable, there is no valid legal reason to allow her to breach the remedy agreement (illegal contract, insanity of one of the parties, one of the parties being a minor).

    I asked her 3 of 4 GrenandaRoger questions (I left out the one demanding "proof", because it may be off-putting, and it may be difficult/impossible to show such proof after 8 years).
