    OBAMACARE RULED UNCONSTITUTIONAL. CONSERVATIVE ACTIVIST JUDGES ARE AS BAD AS LIBERAL ONES.

    Obamacare has been declared unconstitutional. Conservative activist judges are as vile as liberal activist judges. This is not about whether you are in favor or against Obamacare, but about the process. The ACA was a legitimate piece of legislation that should be altered and has been altered by the legislative and executive branches, not by one extremist judge. The method use to "judge shop" in this case is especially repugnant, basically legal angle shooting. Conservatives have correctly complained about judicial interference in issues like capital punishment and forced busing, but there is likely to be a deafening silence by them in this case. The judge's decision may be upheld given the changing makeup of these courts.

    The judge aside, it appears that all this judge ruled is that the mandate to have health care is unconstitutional.

    Obamacare can still continue, and I think that the insurance companies will still have to take people with preexisting conditions.

    Also nothing changes until the US Supreme Court hears the appeal.

    I think you should have the right to opt out of the mandatory health care, but when you do, then you also sign a waiver that you will not be entitled to any health care you can't afford.

    The biggest problem with Obamacare is that it's simply a shell game which shifts around who pays for the cost of our super-bloated health care system, rather than addressing the root cost issues which are going to eventually bring the entire system down if not corrected.

    i think congress already ended the mandate. the judge here said that the mandate was an inextricable part of it obamacare, rendering the whole thing unconstitutional, pre-existing condition protections and all

      JohnCommode: Agree. This was stated in the article. My gut feeling is that this judge would have used any change of the ACA by Congress as a pretext to rule the whole thing unconstitutional.

    Again, this is not about the merits of the ACA, but having the appointed federal judiciary decide matters that have already been decided by the the elected legislative and executive branches. After the elections of 2018, Republicans know that they can't gut or eradicate Obamacare legislatively so they will pursue a backdoor judicial method. The proper method to repeal the ACA is to win the Presidency in 1920, hold the Senate, and win the House of Representatives. What is going on now is pure chicanery and an attempt to override the will of the voters.

    The will of the voters. Like the ones in that bastion of conservative politics, Massachusetts, that elected a republican senator to backfill the Hawkish Ted Kennedy in a special election to put a stop to the ACA?

    That said the whole thing is complete bullshit because if they really wanted to “repeal and replace” they could have done it for the past two years. The ACA, or what’s left of it, ship has sailed. It’s all a political tool to get votes now.

    Not sure if your aware but the generally accepted standard is that if a law is ruled UnConstitutional then the whole thing is null and void normally. The selective enforcement shit pulled by other courts was actually a prima facia case of violating accepted common law for over 200yrs of SCOTUS rulings. But secondarily... what the fuck did y’all think was gonna happen. The Conservatives weren’t gonna finally start playing dirty like the libs have running shit through the 9th circuit constantly to get rulings favorable to them especially when it’s come to Trumps EOs to reverse Obama policy (which they had no issue with how Obama did business which is hypocritical because it only fit their political goals and didn’t give a shit about whether it was a Constitutional Act by a sitting President). Same thing with the judicial nominees, Scheky Schumer is the one who opened the nuclear football in the Senate and then cries foul when the GOP returns the favor. Fuck the Dems they started this shit they get to now eat the same shit sandwich they served up first. You don’t get to cry when the guy you picked a fight with returns the low blow you delivered first.
