    casino cage over payment

    A friend of mine on Saturday , got A low four figures over payment from the cage. He was pretty lit up and didn't notice until the casino was blowing up his phone the next day.


    I am just curious what recourse does the casino have ? OBV he will be banned if he doesn't return the cash


    He hasn't returned there calls , they called him 4 times today.

    I got overpaid $500 at a cardroom casino in LA. The two options I was given was pay the $500 or be permanently banned. I gave them the money. I don't think they can do much else.

    I wonder what the casino would do if they over-paid Floyd Mayweather?

    The casino fucked up, they have no recourse, they can't do shit to you except ban you from the casino.

    Still, I think the casino should offer you a free comp or two, if you return the money considering it was their fuck up.

    I'm sure they'd have a case for suing him and likely a judge would rule in the casinos favor. Not worth doing, but a possibility.

    Also depends on the state. In NV they would be more likely to do it (and win) because the judges and the laws are more casino-friendly, but in a state like CA where there's even protections, they probably will just offer the "return the cash or get perma banned" route as it may be the one recourse that has the less legal implications, because of the amount involved (I will say, I think anything higher than $5K or $10K is actually considered a federal felony if you don't return it back, I think that's how it works for banks).

    Do agree with the comp suggestion by the casino; they could even turn it into the positive by getting attention in the media for being generous towards the overpayee, as well as it creates more biz for their casino for the food/degening.

    Yeah They haven't even called him again after the first day after . So he is going to take the ban as this casino sucks anyway


    I just thought it was interesting a cage could over pay by so much, place is stingy with comps I doubt they offer him anything to return the money

    FWIW I once had the opposite situation. I cashed out a slot ticket for $3K or so, and I didn't notice the lady giving me only $2,800.

    A week later I received a postal letter from the casino saying I was underpaid $200. The letter said, "How would you like it back? Cash or check? Please call us to arrange."

    At first I was amazed at how they tracked me down with this specific transaction because I didn't have to show ID at the cage (no W2G's).

    How could they possibly know it was me losing the $200 considering the thousands of transactions they do every week?

    They explained that the slot ticket barcode info had my players card acct# which is how they tracked it down along with a surveillance video review..

    I don't think he could be arrested unless they could prove he knew it was an overpayment at the time, kept his mouth shut, AND refused to pay back later when contacted.

    But that's a lot to prove.

    The burden is on the casino to pay people properly. For example, if you're at a 6:5 blackjack table and hit a blackjack on a $50 bet, if the dealer pays you $75 and you think it's correct because you're used to 3:2 blackjacks, that's not your fault. The casino sets the payouts and physically pays you, and it's not the player's responsibility to double check their work.

    So this guy could use the defense of, "I was hammered, I don't remember being overpaid, and I don't believe them. I think they're lying to me."

    The casino would have to sue him to get it back, which is unlikely for a $1000 type overpayment. There's no way they could prove criminal intent, because it only happened once, he was drunk at the time, and he's not expected to double-check the casino's work regarding payouts.

    I think he will just get banned.

    Do they ever call anyone to report that they accidentally underpaid them? If not that's a problem
