Looks like Doug's video broke down the numbers, while JNadez just has hearsay.
Doug came out with that video the next day with facts and figures and is very passionate about it. Someone who scammed someone doesn't do that. I believe Doug.
Watched both videos. My conclusion is JNandez is full of shit and Doug is right

This is just a huge misundertanding. Doug sounds like he is being honest to me, J is clearly in his feelings and I was on his side until he challenged him to a fight. That is very immature imo.

Doug is an annoying troll but he is right here and Nandez sounds like a fool. He broke a bunch of terms they could have shit canned his contract earlier but instead he found the way out himself to go do his own thing when he didn't like the terms he was getting. He got his name out there and was trying to gain his new following of hardcore PLO players on to a new project but good luck with that.
I skipped through the Ingram podcast with Polk and the most interesting part to me was something many of us wanted to know about which is the cost of that More Rake Is Better billboard.
Doug said it was 5k for the spot for the month of June and about $6200 total to have the billboard done. Since nobody purchased the space afterwards the billboard stays up until someone else comes along so it stayed up for the entire WSOP. That is cheaper then I thought it would be.
I didn't get involved in this because I was on a trip in Alaska the week all this broke.
Anyway, I just caught up tonight.
Very convoluted and confusing story on both ends, but I agree with the consensus here: It appears Doug is in the right.
Also, JNandez apparently scammed some poor old lady who made scarves for him (for a relatively small amount of money), which is pretty much just LOL.

If you're ripping off little old ladies who make scarves for you, then you're probably the one in the wrong in a business dispute with Doug Polk.
Basically JNandez had "content creator's remorse", where he felt resentful that he was doing all the work and only getting about 25-30% of the revenue.
The problem with that logic is the fact that Polk (and to a lesser degree, Joey Ingram) ALREADY did the work building up their brands, thus getting JNandez's videos the credibility and exposure they needed.
Influence and promotion are huge when it comes to content of any kind.
Anyway, JNandez used an out-clause in the contract and left in the middle of the whole deal they had, which, while legal, pretty much left Upswing in the lurch. Somehow JNandez thinks he's owed $90k, but Polk did a pretty convincing job of showing that he was paid in full.
JNandez still made over $200k for not very much work, so I don't see why he's so bitter, especially since he was the one to terminate the contract.
Some criticized Doug for his response video, but I disagree. Responding to serious allegations about your business ethics is always important, especially if you have nothing to hide.
The only part where I found fault with Doug was the mostly-unrelated fact that he cybersquatted RunItOncePoker.com.
Doug's defense was that he wasn't attempting to mislead anyone, and it was just a site to troll Galfond (a competitor), but that's not a good excuse. Cybersquatting is always a douche move, especially against a competitor. I see Galfond has the domain back now, but Polk shouldn't have squatted that in the first place.
