Latest Chipotle scandal: Workers forced to clock out, still work for free

    http://money.cnn.com/2016/09/01/news...eft/index.html

Pretty sickening story, and I believe it.

While I am not always on the side of labor (and especially labor unions), I am very aware that low-wage workers are often abused and labor laws are often skirted or ignored.

I love to see greedy companies get comeuppance for shit like this.

    Chipotle is such a mess.

First they have that massive problem with contaminated food, which causes a PR nightmare, and now this.

I would love to just see them go away.

It's easy not to like unions when you're a poker player and have no experience of needing to use your union in a dispute with an employer.

Lots of companies do this. In this regard Chipotle is a small burrito. Walmart is the king of unpaid labor. Amazon is also known for this in their distribution facilities.

I wasn't always a poker player. Remember, I'm 44 years old, so I had a work history at real jobs for a long time before becoming a poker player. This includes some real shit jobs as a teen where I got treated like crap and obtained a firsthand understanding of what low-wage workers go through.

This is why I am sympathetic to situations like this. Notice I am the one who posted this article and took the workers' side, which is hardly what you'd expect from a conservative Republican like me, right?

I just don't think that unions are the proper solution anymore, or if they are, they need to be highly reformed. Unions disproportionately benefit longtime ("senior") workers, and often drive wages to unreasonable and unsustainable levels for unskilled jobs. They also make it difficult to fire bad employees, especially if they have seniority.

I am also a product of the public school system (never attended a private school in my life), and watched some really awful teachers get away with being terrible simply because they had been teaching at the school since 1969. Why did these teachers have firing immunity? The union.

I don't want this to be a long debate about unions. We already had that in other threads here.

However, instead of making snarky comments about me being a poker player, take the time to understand that I actually give a shit when ordinary people are oppressed or screwed, as evidenced by the fact that I started this thread at all.

The way they probably will spin this is that the employees weren't efficient in getting all their tasks done before closing.

In my chain gym, they start reracking weights 30-40 minutes before close so that they dont have to stay after since the corporation won't pay for the extra time.

unions are a disease that has ruined people, companies, cities, countries. They all eventually act with out regard to there members. becoming a organized bunch of goons collecting ever increasing dues while failing to represent there members in a way that will stand the test of time.

I do understand the need for unions but I have yet to hear of one that hasn't screw its members in closed door negotiation session.

    edit: love the chicken burrito.

Not many conservatives would start this thread, respect.
This is Neo liberalism and it's not only here to stay, it'll probably get much worse.

As a liberal and ex Bill Clinton supporter I was troubled to find out the destruction of the American worker was set in to motion under Bill Clinton. It was under his watch that we got NAFTA, financial deregulation, consolidation of corporate media, gutted welfare, the explosion in the prison population and the creation of a permanent under class . With the help of Obama and the the TPP his wife is poised to finish off most of the remaining middle class.
Walmart used to do this to their workers while Hillary was on the B.O.D.

D.W. Schultz, one of the most blatantly corrupt corporate shills got re elected. Way to send a message guys.

Chris Hedges deserves his own thread, until then here's a nugget. This is a piece of a speech that is considered by many to be up there with Eisenhower's farewell in its prophetic nature.

It's pretty saddening once you realize this is the truth from someone who would know and not some Alex Jonesian fear porn.

Lol at class action. Each employee will get a check for about $3.50 and the lawyers will net a cool $13 million.

    Idiots.

Well, except the lawyers. They're brilliant.

It was set in motion during the time of Nixon if not before, and is due to many complex factors of which presidential policy is only one. Accelerated primarily under Reagan and Clinton though.

And democracy is the worst form of government (except all of the others). Meaning, there is no perfect way to run a union. There will be compromise, corruption by some union leaders, stupidity by the rank and file in supporting bad policy, etc.

So, absent more workers being members of unions, how do you propose to strengthen the protection of workers who are liable to being abused by management?

LOL.....it depends on whether or not the workers settle, or if the NLRB gets involved. If the NLRB finds this worthy of a ruling, and make their ruling in favor of the workers......they could not only get their wages back, but also get paid out in civil penalties.

There was a case in Boston where Upper Crust was found to not have paid out OT to 67 workers (mostly Brazilian) between 2009 and 2011, around 425k. The NLRB ruled in the workers' favor, and they also got a 37k top off as a penalty to Upper Crust, *and* Upper Crust had to pay the workers' legal fees, too. Each worker got around 7-12k, and Upper Crust filed Chapter 11 after, the companies' rep was damaged (it was eventually bought out by a private equity group).

Granted, that was a case against a small to medium sized company, as supposed to Chipotle, who probably has an army of lawyers ready to fight (and it seems like they will). Which is really another bad PR move by them; if I were the company, just offer a generous settlement and take the L. If it gets to the NLRB, they will be drawing slim IMO and it would look even worse for them if they have to pay out + the penalties.

Also, don't go to Shitpotle. If you live in a major city, I guarantee there are way better places to get a burrito.

I prefer Qdoba for a fast burrito fix. Just happens that I work 400 yards from a Chipotle and honestly it's just so convenient, I can't not eat there.

The chiptopia rewards program running July through September is thick with free burritos, and I'll hit the requirements for the free $240 worth of catering without even trying, and will earn 10 free burritos for buying 25.
