Uhhh... Hate to say this, but if spoken or written in a general manner, this is currently “protected” First Amendment speech per Supreme Court rulings. What is NOT protected is speech that related to specific efforts to commit such violence, e.g. communications in the planning stages of specific violent acts to be committed by a group, as they would be considered as part of a specific conspiracy to commit such a crime.Publicly advocating and encouraging the violent overthrow of the government (or a state government) is a crime.
Don't hold your breath waiting for Trump or any of these right wing hate machine fuckheads to be held accountable.
So even if Trump were to say during one of his nationally televised briefings that people in states controlled by Democrats should violently overthrow their state governments if they don’t end the lockdowns, such speech might cause him to lose re-election, but he couldn’t be criminally prosecuted for doing so if he became a private citizen before the statute of limitations ran out.
