Chesebro becomes second Trump lawyer to plead guilty in Georgia
Kenneth Chesebro, an attorney who wrote a series of memos devising the Trump campaign’s alternate electors strategy in 2020, pleaded guilty to one felony Friday after reaching a deal with Georgia prosecutors in their election interference case.
Chesebro, 62, was set to go to trial Monday and would have become the first defendant in the case to do so.
He has now avoided that prospect at the last minute by pleading guilty to one count of conspiracy to commit filing false documents during a brief proceeding before Fulton County Superior Court Judge Scott McAfee.
His guilty plea comes one day after Sidney Powell — a former Trump campaign lawyer who was set to be tried next week alongside him — accepted a plea deal with Georgia prosecutors. Powell pleaded guilty to six misdemeanor counts and was sentenced to six years of probation.

When Republicans gathered on Dec. 14, 2020, claiming to be legitimate electors casting the state’s 16 electoral votes for Donald Trump, they met at the Georgia Capitol in a room just upstairs from the building’s public entrance. A Trump campaign official asked for the electors’ “complete discretion,” telling them to say only that they were meeting with two state senators who were there.
“Your duties are imperative to ensure the end result — a win in Georgia for President Trump — but will be hampered unless we have complete secrecy and discretion,” Robert Sinners wrote in an email uncovered by investigators.
But reporters for The Associated Press and other news organizations noticed the Republicans entering the building and were eventually admitted into the room, where they photographed and recorded video of the proceeding. In the chaotic weeks after the 2020 election, the gathering’s significance wasn’t immediately clear. But it has emerged as a critical element to the prosecution of Trump and 18 others who were indicted by a Georgia grand jury in August for efforts to overturn Democrat Joe Biden’s narrow win in the state.

The dispute over the leading GOP candidate's constitutional fitness is moving forward. Other cases around the country are progressing, too.
The legal battle over Donald Trump’s ballot eligibility in Colorado took yet another step closer to trial next week, as a state judge there rejected Trump-aligned dismissal efforts but without signaling an opinion on the ultimate outcome.
Colorado District Judge Sarah Wallace called “pivotal” the legal question of investigation and enforcement of the 14th Amendment’s disqualification clause. But in resolving several issues in a Friday ruling, she said that crucial matter is “best reserved for trial,” which is set to begin Oct. 30.
Section 3 of the amendment bars anyone from office who took an oath to support the U.S. Constitution but then “engaged in insurrection or rebellion against the same, or [has] given aid or comfort to the enemies thereof.” The Colorado suit was filed by Republican and unaffiliated voters, represented by Citizens for Responsibility and Ethics in Washington, who want to protect the rights of voters “to fully participate in the upcoming primary election by ensuring that votes cast will be for those constitutionally qualified to hold office.”
Other cases have been filed around the country, including in Minnesota — where oral argument has been set for Nov. 2 — and in Michigan.
And though Wallace rejected pretrial procedural claims from Trump and the Colorado Republican State Central Committee, the judge made clear she "makes no judgments on the merits" of Trump's "constitutional fitness as a candidate by way of these rulings."
Of course, what we want to know is how courts will decide Trump's eligibility, as he also faces several criminal and civil cases.
We still don’t know, but we’re closer to finding out — this Colorado case could have national implications. And what the answer is through this first round of litigation could be less important than when it arrives, especially since the issue could be more definitively answered on appeal — perhaps by the Supreme Court.
