If they were domiciled in a community property state and they don't have a prenup, she has a very strong argument. Any income earned during the marriage is presumed to be community property. The burden is on the other party to rebut the presumption. Solomon may be able to argue that his bankroll used in the game was his entirely separate property, and thus Solomon's year end poker profit is as well. However, it is far from a slam dunk. This does not abrogate the fact that Anderson is a money grubbing whore, however.

it depends on the state of the marriage when the winnings happened...

Pam Anderson can have an equal portion of the winnings if the two were not separated and thus the parties acted as if marriage community was in existance....

but if still married yet separated when the 40 million was won, the winnings are not considered community property...thus she would not entitled to half of it ...still, the judge may consider the winnings as indicative of the earning power of the estranged husband and he may increase the spousal support she is otherwise entitled to...so Solomon may yet be screwed one more time by Anderson.
