Appeals Court Rules Wisconsin Indian Tribe Can Offer Electronic Poker Tables

However, according to the Wisconsin State Journal, the U.S. Court of Appeals for the 7th Circuit, which is based in Chicago, recently overturned that decision.

In a 20-page opinion, the court ruled that because non-banked poker is not criminalized by the state, it cannot prevent the tribe from offering electronic poker as dictated by the federal Indian Gaming Regulatory Act (IGRA).

"IGRA creates a regulatory scheme that respects tribal sovereignty while carving out a regulatory role for the states on only the most lucrative forms of casino gambling and hence the forms of gambling most susceptible to organized crime," wrote Chief Judge Diane Wood. "States may choose to bypass this regulatory scheme if they are willing to ban gaming across the board. But the states lack statutory authority to deny an Indian tribe the ability to offer gaming that is roughly equivalent to what the state allows for its residents."

In 1999, Wisconsin decriminalized the possession of five or fewer video gambling machines in alcohol establishments. The court seemed not to differentiate between such machines, which include run-of-the-mill video poker, and electronic poker tables.

Been a long time since I played live poker. Don't miss it much.

What's depressing? Only thing missing is the depressed, bored dealers.

What's depressing live is the slow pace, paying time to see very few hands & tipping some dealer who is fumbling the cards. I hate tipping in cash games. I lack the spine necessary to stiff the dealer.

The PokerPro tables solve this and more. I think the pace of play makes for a game with more action. The novelty tends to get people talking too.

I would make an effort to play if it was offered close to me.

They tried this year's ago in many b&m poker rooms. People hated it after the novelty wore off.

I live 20 minutes from that casino. The poker room never got to busy except for there tournaments. You'd be lucky to have more than one cash game running at a time. I talked to them yesterday doesn't look like there gonna be brining the tables back as thete makin too much money from the slots that they put in there

These are great in cruise ships. Inexperienced players like the fact they can sit down and play and charge it to their cabin and real players just like the fact they can play.

The 10% rake up to X gets tired fast, but I've sat at some tables where it didn't matter.

Cruise ship was last place I played live. The games were so much fun and so soft I may spend the rest of my life trying to duplicate that experience.

The rake varies from ship to ship. The rake wasn't 10% as I recall. However, you are correct it didn't matter!

The rake is absolutely horrible on these electronic tables, and I believe the game is unbeatable long term (that is, if you could sit and play every day for a year), even given the usually TERRIBLE competition you face.

I played these on a cruise ship on two trips -- one in 2009, one in 2011.

In both cases, the game was 1-2 NL, and the players were mind-bogglingly bad. Like the absolute worst NL competition I've ever faced.

By "bad", I mean that most were loose-passive and clueless. They were both easy to read and easy to run over.

I even had someone folding the turn of a pot of like $100 when they had $2 behind.

At the same time, you have people calling off their whole stack with bottom pair.

You rarely get raised unless you're against a very strong hand.

So you can control both the action and the bet sizes, regardless of position, and know when to bail out when up against a strong hand. And when you have the strong hand, you get idiots calling off big bets with mediocre holdings.

Sounds like a dream game, right?

That's what I thought, and indeed, I was by far the biggest winner on the ship both times.

However, the rake was absolutely obscene. I think it was 10% no cap. It just ate me up. I remember one night my father was sitting next to me, and watched me bust each and every one of my 5 opponents. Eventually I was left sitting alone. My dad looked down at my stack and asked, "Wait, where did all of the money go? You bought in for $200, right? Is the rake really that bad?"

Indeed it was. The rake was the biggest winner. I was the second biggest, despite busting everyone.

BTW, there is a trick you can utilize with these machines on cruise ships. You can usually charge chips to your stateroom account -- an unlimited amount -- and then withdraw them as cash. You can do this with no fee only at these machines (but make sure to verify this), whereas the rest of the casino charges 3% for stateroom charges. Anyway, this basically allows you to get unlimited airline miles or cash back from your credit card, as far as your limit will allow. I did this on both of my cruises and it worked. It's not even against the rules. It's just a loophole in their shipboard charging system they haven't closed yet, and I believe it works on any line with these machines.
