The plea agreement called for the DA to not recommend life without parole. They had already decided not to seek the death penalty because he had no prior criminal history, despite the fact that he committed premeditated murder, as well as attempted murder.
On November 21, he was sentenced to life in prison, being first eligible for parole after 38 years. Since he is 44 and already served 2 years, he will be eligible at age 80.
While it is very possible he will die in prison (especially because he has Type 1 diabetes, which shortens life expectancy), it really sucks that he still has hope of being parole. Presumably they will parole him at age 80 if he makes it that long, as he's unlikely to be deemed a danger to society at that point.
Had they seeked the death penalty, he likely would have pled down to life without parole.
