I would bet anybody a whole lot of money Micon does the right thing, like a man, and comes back to face his charges. I wouldn't doubt with how good a family he has, he can also bond out. He should prearrange with his family AND a bail bondsman working with his lawyers, to ensure upon his arrival he does the absolute MINIMUM of hours in the county.
If he sets it up via his lawyer and his family+bail bondsman, that he will come back enter a plea, get booked, and then bail out that he does the absolute minimum of time until the trial.
Honestly you didn't do anything violent or mean, you will get bail bro. Just keep that wife of yours happy, she is going to be your most important asset through all of this!
Agreed he'll be coming back, my guess is before the WSOP, so that he can achieve the maximum center of attentioness that he always seems to want.
By the way, in my opinion, the bitcoin/statute argument raised in this thread is a legal issue that would be decided by the Judge as part of his lawyer's motion to dismiss, probably filed along with a motion to suppress evidence, if they try to go the Phua route in fighting this. Jurors only decide factual issues such as whether Micon was ever really operating Seals or just a marketing guy.
If Micon comes back prior to the WSOP and makes bail (then trial say in late 2015 or early 2016).....will one of his conditions be that he doesn't gamble?
That would be worse than prison for him if he couldn't play and/or go to any casinos.
With the caveat that I mostly do civil and not criminal work in California, I think the answer depends upon what kind of deal is negotiated by Micon's lawyer.
The 2 factors usually considered by Courts regarding bail is (a) risk of flight from the City/State/Country and (b) threat to society. Micon may have shot himself in the foot regarding risk of flight by moving his family to Antigua after the raid. Phua and his Chinese pals, for example, with their private jets, clearly had a flight risk and were given home detention pending the outcome of their criminal charges.
Maybe Chernoff will produce the lease that Micon says he signed prior to the raid and be successful, who knows.
An educated guess is that he would not be barred from the Casinos or live gambling as a condition of bail - though Harrahs may independently decide to do so, again who knows for sure.
He bail conditions will certainly include a surrender of his passport and an agreement to not operate a gambling site while in Nevada.
Everything else is probably still up for negotiation.

I think he is trying to decide whether he rolls the dice and comes back to the US to defend this.
Wonder if there will be another divorce in Micon's future.

I would like to add that while I discussed selling the name to Micon and we chatted briedly via email about my old friend, I offered it for even a little less, he wanted it but paypal did not seem to be an available option and I do not do the bitcoin thing.
What do you guys think is a viable option for it?
I wish Micon all the best I never wish anyone any harm but Brian is not quite as quick in a business sense as one would imagine he should be.

I suspect the domain will be of little interest. The name is tarnished and is possibly only of any use to Micon right now. I understand he has other concerns at present.
Also, it is much easier for the US government to seize a .com domain, compared to a .eu domain, so this would further devalue the domain.

I honestly can't see this happening even with great lawyers. Its well established that bitcoin has value and is even traded on regulated exchanges. There is a good reason why no one else in usa is running something similar. Druff has already covered this at length though.
But even if he tried to argue this point somewhat effectively, what will fuck him over is that it sounds as though the prosecution has copies of all of his electronic correspondence through such mediums as Skype. They have him directly stating how much money in US dollars the site is making per month. How can he argue no value when they have him talking about it himself?
I can only imagine what other correspondence they have including discussions around how to evade authorities...

The dot com offers natural type in traffic that is targeted and wants to play. Targetted natural traffic = revenue, how much, well the old site name dot com based on a thread I found made 50 btc the last year. Even if he spent $1k to buy the name he would make that is weeks of rake back and on and on. The myth is .com can be taken and not .eu, that is not true, usgov takes many .eu names.
Based solely on a business decision it should be a no brainer for him to buy and watch his sign ups and action grow but what do I know. Who wants to see their venture grow and grow for $1k.

BTW, even if these rumors are true, they may not mean much for the legal case against Micon. As he has been involved in bitcoin since before he joined Seals, he can simply say that he was withrdawing his bitcoin that he had collected over time.
I have limited knowledge Dan but since the ledger is public and if they did not mix in a large scale before cashing out it should not be too hard at all to tie the address to the business and then to Micon. Which brings up something that has not been mentioned, what stops the US from bringing further charges for say tax evasion immediately after these charges?
I think even if he pled or got a light sentence he can never sleep well.
