His probation officer's information is below (have not been able to reach her yet). I was also told to contact the state police once the 22q foundation confirms that payment was never received.

Joeu please as soon as you can confirm that money was never sent (we all know it wasn't, but a statement needs to be made by the foundation before we can bring charges against him).
The fact he is on probation changes everything. The burden of proof for a violation is nothing compared to a real charge. They could violate him even if he somehow squirmed out of a charge in the charity case or pled it down to some bullshit. He is probably looking at 30-60 days any way you slice it.
If he happens to get a judge/prosecutor who looks at his record and thinks it is a pattern, could be bad news for him. Only thing that helps is the fact it was only a few grand we are talking about here.
I think it's a good idea, however please do be polite when you call and have a written list of details you wish to discuss.
IE. 5k poker investment, not sure how much exactly the 22q amount is, how this has impacted you, what laws you believe he has broken, etc.
If 20 people phone her she could also just get pissed and blow it off.
I would like to reiterate, I have privately apologized for my attack on Druff. What I wrote will remain between us but, I will say, he graciously accepted my apology & everything is fine between us. If I could take it back & never have written it, then I would.
Looking back at the timing, I was obviously composing my apology letter when Druff posted the above.
I also apologized to 4BET on IM on this board but I'm not sure if he received it since I never heard back from him. If you did not receive that apology 4BET, I am publically apologizing to you here. You were right all along.
I would also like to apologize to anyone that got involved in this BAP because of my participation. Highly unlikely, but just in case.
It's kind of bad that SixToedPete uses this incident as a way to make a personal attack on Druff and praise Mason Malmuth of all people which Mason now all the sudden is interested in this issue:

Regarding calling the probation officer, it's important to keep the following in mind:
1) Do not call unless you were a direct victim of Jasep's. Who is a direct victim? Anyone affiliated with the 22Q foundation (such as JoeU), anyone who donated to 22Q through Jasep, anyone who had a piece of Jasep's 5k BAP here, and anyone who had any other financial dealings with Jasep that were shady since September, 2012. I mention September, 2012 because that's the date of his probation. The 22Q foundation money definitely falls into this because he was still "collecting" the money to send them at the time his probation began, and it's likely he never sent it, which is obviously a crime.
2) Do not direct her to this convoluted 85-page thread. There's no way she's reading all of this shit. You need to make the facts clear and concise. For example:
"John Sepulveda ran an internet podcast through his website for the benefit of a charity called the 22Q foundation. I donated money to the foundation through him, but I believe he never sent it and just pocketed it. He did this to many people, for a total of thousands of dollars. When we contacted the foundation, they could not find any record of his donation, and will be making an official statement about this shortly. John refuses to provide any proof that he actually submitted the money. We have a copy of the 50-hour podcast where he collected all of the money and announced how much had been received."

Offer to provide as much evidence as you can, but DO NOT just direct her to this thread, because it's overwhelming to read and full of infighting.
To be honest, the charity stuff will have more "teeth" than the BAP scam, for obvious reasons, so try to focus more on that.
I certainly hope Projekt: Step doesnt turn out to be a scam either (no vlogs, no updates for weeks) but thats definately an appropriate response if OSA is setting up a scam.
On a serious note, 1 reliable person as a contact from PFA makes a bit of sense and if it looks like its going blown off more people coming forward sounds reasonable.

The 22Q podcast is really the smoking gun.
Here you have Jasep in his own voice announcing how much had been received. This can be used as evidence against him, because he knowingly recorded himself and broadcasted it to the public.
If he cannot show that he actually submitted the money (sending a check today to cover his ass won't work), he has committed a crime, and the case is airtight.
Again, you need far less evidence to prove a probation violation to convict someone through a criminal case. This is because probation usually has very strict conditions that restrict people's usual freedoms.
For example, probation given to a DUI offender might state that the defendant is not allowed to drink alcohol outside of his home. All you need is some reasonable proof that the guy was out drinking, and you've established a probation violation. You don't need to catch him driving drunk again.
I am guessing that Jasep's probation has a number of terms regarding scamming and financial transactions to where some violation can easily be found here.
That detail isn't particularly important.
We believe he really did receive a threatening e-mail.
We also believe he sent it to himself.
But that's probably a hard thing to prove.
In these sorts of situations, you want to go the easy and simple route.
People watch TV and see cunning police investigators putting a lot of time, thought, and energy into investigating crimes.
That typically doesn't happen in real life. Most law enforcement personnel are overwhelmed, and have little time to investigate the more "minor" cases. It's always much better if you do as much work as possible for them, and then present what you have on a silver platter. When you do this, you have to make sure your information is straightforward, easy to understand, and easy to verify.
Yes, it wasn't a huge deal. I have always liked Hockey Guy, and was disappointed in some of the things he said to/about me earlier in this thread, but I am over it now. I know that handicapme has apologized as well, and I also appreciate that. (He was also less outspoken about it in the first place.)

I have no idea about probation in Rhode Island, but it's a northeast state, and I assume more judicially liberal than say Mississippi. I would be surprised if he went to jail. If he does, it will be because of the heinousness of the charity angle. If he stole 3k from anything besides a charity, him going to jail wouldn't even be in the conversation imo.
In Pennsylvania, I knew a few people on probation, and it's absurd. A guy I knew was convicted of vehicular manslaughter for killing his best friend while drunk behind the wheel. Real asshole. He got pulled over routinely for driving w/out a DL, as he'll never have a license, and never was jailed. He drank, posted where he was drinking on facebook posts, etc. Nothing ever happened. He was also a heroin addict in addition to being a drunk. He would come up dirty all the time for both alcohol and heroin and was out driving around, getting into trouble. His probation officer only acted on a 3rd strike every 6 month period. So essentially, unless he flunked 50% of his tests, nothing ever happened. He died this past month from a heroin overdose, so he won't be out drunk hurting anyone again, but I always found PA's probation absurd. Ohio is much quicker to violate, but PA is like many of the northeast states in their approach. For those looking to see him incarcerated, temper your expectations. It's possible, but I wouldn't bet on it.
The father of the girl with this disease is certainly the best person to bring a little heat to an overwhelmed probation officer.

Now he so proud of himself for making that decision, even though 22Q itself is very legitimate.
The Northeast is very strange. In Mass he would almost certainly go to jail for violating probation, not really sure about RI though, it's a much smaller and poorer state, so they probably turn the other cheek to this stuff. Assuming everything is true, his previous conviction is Identity Theft, so defrauding a charity added to that is pretty major stuff, and a pattern. I would be very surprised if he got off without jail time, although I suppose it depends on what his sentence was from the Identity Theft

Joeu once the charity makes an official statement can you please post it so we can go to the state police. It would prob work better if you or your wife did this, however if you can't we will gladly do this. Once they confirm that it wasn't sent according to the court officer I spoke to this morning (afternoon?) it's a pretty air tight case since he technically recorded himself saying the money was received.
