Here is the pertinent info in the TOC regarding poker tracking software or home made HUD and the like......again you know as well as I do that there will be idiots who decide "the rules don't apply to me" and will try to skirt them, they will get their accts closed, and you will see threads pop up everywhere stating "Ultimate poker closed my acct for no reason"
6.8. Unethical External Assistance. Players are prohibited from utilizing an external resource which is designed to provide the Player with an unfair advantage over other players.
6.8.1. These external resources include third-party software applications and databases as well as websites, web-based databases, subscriptions services and the assistance of any other person regardless of whether or not that person is also a Player.
6.8.2. Management defines "unfair advantage" to mean the obtaining and/or compilation of any information about other players other than that which the Player has personally observed through Player's own gaming activity.
6.8.3. Furthermore, the Player agrees to allow Management to actively pursue the detection and prevention of Unethical External Assistance including, but not limited to, the identification and reporting of software applications running concurrently with the Software or Websites.
also rule 6.8.3 will aid in the detection of sites like "GoToMyPC" and other remote software applications so my suggestion Is that if you really want to play on the site just move the fuck to las vegas and not fuck it up for the rest of us
I can see this coming already....people bitch and moan all this time about there being no legal online poker any longer, argue for states or feds to pass some kind of bill, bills finally get passed, sites finally get opened and people fuck it up, people go back to bitching about there being no legal online poker

This was obvious it was coming. I think some of this basically covers all the garbage that ruined online poker. Ghosting/HUD/Software/Bots/Datatmining etc... Pretty much all covered, right there.
Some may be looking for a new job soon after you factor in no rakeback or affiliate deals.
Here's another REALLY interesting thing in the TOC IMO
4.16.2. We reserve the right to disclose your personal data to third parties including government institutions, or police authorities, regulators and other governing bodies or competent authorities when such data is requested or required in order to comply with any applicable law, regulation, legal process, governmental request and/or judicial order.
I think that this clearly shows that they will turn your ass in to the police if you break the rules/laws/regulations just as they would if you were in their casino playing and did something illegal. I think that some people will find it a rude awakening when they figure out that playing on Ultimate Poker is no different than playing in the casino because it will be considered an extension of the B&M casino
They also have several references to the use of BOTS/sharing accts/selling accts so ya I think people will be sorely disappointed if they think they will be able to just get tons of rakeback and have it be like the old days.
If people violate these rules, it won't fuck it up for everyone. The violators will just get kicked off the sites.
It will only cause an issue if there is a mass number of people falsifying their location and this creates a legal concern for the federal government, regarding these rooms opening up the door to illegal interstate online gambling.
This is a good point, and I discussed it to some degree on radio.
Some people are used to cheating on these sites and getting away with it, or at worst having their accounts closed. These same people might be in for a shock when they get arrested for the same activities on these new, regulated sites.
At the same time, a lot of stuff in the TOS is just legal ass-covering, and in reality a lot of these things may never be enforced.
They will, however, be reporting all of your winnings to the IRS. Count on that.
BTW, I shot them an e-mail to ask about the methodology they use to verify your Nevada location, and I got this response:

I highly doubt that small group of cheaters will have any effect on the overall game. Too much revenue at stake. What may be surprising to some, is how aggressive everyone with skin in the game go after them. What will most likely happen is they will be made an example of. And you never want to be THAT guy. They sometimes get hard, hard time just to prove an overall point to others thinking about trying the same thing. Some inevitably today, are already thinking in 2013 they are smarter than and more sophisticated than big, big Casinos with lots of force to have people prosecuted.
This will be interesting to watch unfold.

Winning players are bad for their business and they will be treated as such. Long term winners will be under scrutiny for cheating. What they want are a bunch of breakeven players and some fish. Keep depositing and they won't bother you, keep withdrawing and you will have trouble.
In many cases online sites don't care for big winners but that is because of obstacles people have to go through to put money on (costs the site money too) and the cost of sending money to Americans that they are eating some if not all of in some circumstances.
For Ultimate Poker a lot of these expenses aren't as much since they aren't dodging the law and they don't have to worry for now about new people not signing up when they will be booming with new customers for a while as long as they can fix various signup issues people are having.
According to Pokerscout, Ultimate Poker has now passed up Seals With Clubs as a bigger poker site in less than 72 hours of launch.

I'm not sure whats worse claiming these things are what ruined online poker or the fact you lump completely legal things with illegal stuff. Huds were legal and the only people who complain about them are the 2 tabling fish that dont understand how to use them correctly. If a site wants you to multitable you need to be able to have a hud. Thats almost like saying in a live environment you cant look at the other player during the hand.
