You're right that the disclaimer would have been smart for legal/channel preserving purposes, but I don't think it would have saved him here. It also would have ruined a lot of the image he was trying to present to idiots -- that he is a gambling genius who effortlessly wins 99-100%. Once you create doubt by dropping disclaimers in there, the gullible potential customer base might be less enthusiastic.
I don't think it would have saved the channel, though. YouTube wasn't looking at any of this stuff nearly as carefully as we were.
Someone at YouTube finally took a moment to examine the channel, and the whole thing looked really scammy to them. Obviously it doesn't take a genius to see this after just a few minutes. Combined with his previous strikes regarding Betonline and whatever else last year, they decided he was up to no good, and canned the whole thing. This is also why it's unlikely he will win his appeal. I don't think a disclaimer would have changed anyone's mind who made this decision.
