I feel weird reading any posts by Wiz which are serious instead of some form of abstract craziness.
With that said, for those who believe this was an unjust raid/prosecution, answer this:
Nevada and the United States both have laws against operating unregulated, unlicensed gaming sites.
Regardless of whether or not you agree with these laws, should the government just not enforce them?
If you believe that, what about those companies and individuals who have been playing by the rules the entire time? Why should they get the shorter end of the stick for staying within the parameters of the law?
You might say, "Well, these laws are set up only for the government and mega-corporations to profit, so the little guy who can't get a license should be able to compete."
Even if you want to believe that, what about the other "little guys" who also would like to run online poker rooms, but don't do so because they are afraid of the legal consequences? Why should Seals get a free pass, just because they were willing to break the law when others weren't?
The bottom line is that there would be a million bitcoin poker rooms AND unlicensed cash poker rooms if it were legal to put them up in the US. The only reason Seals succeeded and Micon made all that money was because he was one of the few willing to break these laws.
That isn't innovation or creativity. It's affectionately known as risk.
Most of us here are/were gamblers. We know very well about risk.
And when you risk, sometimes you lose.

Everyone else chose NOT to make this money only because they knew they would likely go to prison for it.
Indeed, Micon got in trouble and is now facing the likelihood of a prison sentence.
Everyone else didn't make the money Micon did, but they are walking free.

Given the business he was running, he basically did everything possible to get caught. He then made it worse by pretending to be some kind of victim and continuing the operation.
All of these bitcoin guys that get arrested seem to be smart guys on the surface, but when the facts come out about how they ran their operation and get caught, they come across as morons. They brainwash themselves and others into believing everything is ok and they are doing nothing wrong.
I bet Micon's ex partners in Seals are now shitting themselves more than ever. If I was one of them, I would be pissed that Micon kept running the site after the raid as it only brings more heat down on him and thus potentially more heat on the people he used to work with. It has been thought that Micon never knew the real identity of these partners, but if he does, does anyone really believe he wouldnt give them up if it meant a reduced punishment ? Had Micon given up on bitcoin poker after the raid, and fallen on the sword, they probably would be home free.

Downsides to this are that the probation officer will make him get a real job and he has to serve like 13 months in jail.
He was violating the State's gaming licensing laws, the heart and soul/bread and butter of Nevada. It's not about "overcharging" to see what sticks. It's about public deterrence. No doubt they would include a punishment of public flogging if it were possible.
While I can envision some sort of plea with a fine and limited prison time, Micon's problem may very well be future IRS issues and federal charges, particularly if he continues to operate SWC.
I wonder how long he'll be able to stay and operate in Antigua - I think his 60 days without a license are almost up. If he can post bail, I'd look for his celebrated return to Nevada sooner rather than later.

With gaming operators now involved legally in Nevada, no matter that WSOP Online is kind of a fail site, the state is looking to raise its feathers and give anyone who thought of doing something similar to this a rather quick and sobering reality check.
I think this is ultimately what is going to fuck him the most. He is quickly becoming like those people who claims taxes are unconstitutional; judges give those guys 5-10 years without even blinking. He should have done what his partners did after the raid, walk away and then he should have begged for mercy. Now that he further pissed off Vegas gaming by continuing to operate in Antigua, i wouldnt be surprised if gaming make a call to the other branches of the government (IRS, FBI) to get more charges.

Don't forget that to the extent he is still running a site that is allowing Nevada residents to play on it I suspect the AG will take the position that it is an ongoing violation and I think he would win that arg......very high likelihood that the SOL hasn't yet started to run....also remember that an arrest warrant doesn't equal the start of things if he stays out of the juris......
