If they would have to do it in Nevada court, they are fucked, because the state protects casinos.
If somehow they could get it done in federal court, they might have a shot, though honestly I don't see them as liable. It is unreasonable to believe that a large hotel has to monitor the movements of thousands of guests. I suppose there could be a small amount of liability in letting him check in under someone else's name, but that really wasn't a factor anyway. He could have checked in under his own name and accomplished the same thing.
