This is an effective strategy that works well in all aspects of life
It didn't take much research to see it's going to be a no brainer for SCOTUS to overturn the unlawful decision by the Colorado Supreme Court. They used Section 3 of the 14th amendment to kick Trump off the ballot. Here it is:
"Section 3 Disqualification from Holding Office
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability."
There's a Catch-22 here. And that is the oath taken by members of Congress to "support" the constitution. The Presidential Oath is different:
“I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.”
"Preserve, protect and defend" is different from "support." But that is not what SCOTUS will focus on. They will focus on Section 5 which states:
"Section 5 Enforcement; The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article."
Nowhere is Section 5 did Congress give state courts any authority. And they had a damn good reason not to give those state courts any authority. They wrote Section 3 to prevent anyone who served in the Confederacy from serving in Congress.
If they gave any authority to the states do you think Virginia courts would have disqualified Robert E. Lee had he chose to run for Congress? Or how about Jefferson Davis? Do you think Mississippi courts would have prevented Davis from running for President?
Congress kept those decisions to themselves because they knew that giving the states any rights would defeat the entire purpose. So the Colorado Court is not just exceeding it's authority. They have no authority at all. What they did is unlawful.
SCOTUS is going to shoot the Colorado Court down in a New York minute--based on Section 5.. You heard it here first.
