Only reason they sought death penalty isn’t because they think he’ll get death. Zero chance of that. But in order to sit on death penalty case, one must be open to giving the death penalty. This is a game by the prosecutor wasting millions because they know they probably lose or hang with jury of his peers. Their hope is a death penalty jury skews old and more conservative. Still a decent chance of hung jury.
