This happen to me yesterday. I thought if there were riots in San Diego that they would be in downtown San Diego. Well the shit popped off in La Mesa which is very close to where I live. You can't mandate that everyone has access to the best lawyers. In fact, that wouldn't even be possible because there wouldn't be enough "best" lawyers to go around.
Given that quality of legal representation is so huge in criminal cases, and given that there's no way to prevent the best ones from working only for clients who can afford them, there's always going to be a class gap in criminal justice, which also means there will be a race gap.
There is probably some racism in the court system, as well, but not nearly to the extent that's being accused (except maybe in some hick towns in the south). People are just confusing the classist system with a racist system, for the most part.
With that said, there really aren't that many cases where black people are unfairly convicted or sentenced. It's more of the opposite -- guilty rich people escape appropriate punishment more often than guilty poor people. Is that unfair? You bet. However, it doesn't mean that the poor people are getting screwed -- only that the rich people are getting something they don't deserve. Those are two different things.
