There is a big problem with the Jan 6 committee's referral to DOJ for Trump to be criminally charged. By the constitution Congress is purely a legislative body. It does not have the constitutional right to refer anyone for criminal charges. Only the Judicial Branch has that authority.

The house Judiciary Committee will weigh in on the events of J6 exposing the criminal negligence of Pelosi, Pittman and others. And it will all be introduced as evidence in the trial of Donald Trump, if it occurs.
But there is also a lot more evidence to be brought into any trial of Donald Trump. That's evidence of FBI operatives in the J6 crowd. Why were over 700 people charged with crimes but not Ray Epps? Epps is on film telling people they need to "go into the capitol." Other people were charged for a lot less.
FBI Director Wray testified before Congress recently. One congressman really put him on the spot, asking if he had operatives dressed as Trump supporters in the J6 crowd. Wray wouldn't answer the question so the congressman pointed out that if there weren't any operatives in the crowd then Wray would have absolutely no reason to not answer no.

There is ample evidence that the FBI had operatives in the J6 crowd. And this is a big problem for Merrick Garland and any prosecution of Trump. Because they will be exposed in a Trump trial. A lot of questions there. For starters:
Did the operatives foment violence?
Did they plant the bombs?
Did they make sure the doors were open?
Were they in the know about the planned low security presence?
Biggest question of all....
Did the FBI know that some groups planned violence that day (the capitol police knew there was planned violence), and if they did know....WHY DIDN'T THEY STOP IT BEFORE IT HAPPENED?
