LAS VEGAS HOTELS RESORT FEES- Potential class action lawsuit

Thanks to Druff and PFA radio, I did not know about the unfair hotel resort fees being charged years ago in Las Vegas. This morning, I get a flash ad asking if I stayed at a number of hotels during 2024 and Yes, I did stay at Santa Fe Station (my fav). My female friend and I did stay at the Palace Station as well, but she paid the fee, so she would have to file with the law firm.

So I did fill out the information and got an acknowledgement text back. It appears that there is no actual lawsuit yet and these California lawyers are only investigating right now. If and when I hear something back, I will update here. I did do a search on the topic first and there was nothing specific on any class action lawsuit I could find.

Replying to these things are a complete waste of time. Some Gringo law firm makes all the money. Class members likely will get a coupon on a future stay (if anything).

Very true, I guess I'll take my $10 cash. My main idea is atleast someone is taking on the resort fees.

This is actually worth discussing, but not for the reason you might think.

I get a lot of these ads on Facebook, too. Not just for Caesars and resorts fees (which I've seen before), but also for other things which could potentially apply to me.

I don't respond to them. Why? They range between a complete scam (the law firm is fake, and just harvesting data) and a semi-scam (there is no class action suit, but they're just trying to collect information to pitch to area attorneys to buy from them).

In reality, you have no need to respond to these ads, because that's not how these suits work. If such a suit takes place, class members (such as us) will receive notification of the suit, and given our options at that point.

You should 100% ignore all Facebook class action suit ads.

so i'm being a little lazy today and actually don't want to dig into this, but is the theory of resorts fees is because they are taxed at a lower rate than the actual "room rate tax" ... thus a "legal tax loophole" , thus the hotels actually get to keep more profit...??

Nothing worth following. It's fake news.

If there is an actual lawsuit, you will read about it in the news. Even if you miss it in the news, you'll get notified if you're part of the class.

Facebook is full of scams, lies, and clickbait, which is why in general I don't like when stuff from there gets reposted here.

No, they are taxed at the same rate as regular room rates. At one point there was no local room tax on them, which made it a bit cheaper for the customer (not the hotel), but localities clamped down upon that, and now almost every jurisdiction requires remittance of room tax on resort fees, as well. This actually makes sense.

Resort fees were accomplishing two major things for hotels:

1) Allowing them to advertise or be listed in search engines with a phony low price. This enticed people to book the room, only receiving the bad news at the end, when they've already gone through the effort to book and emotionally committed to having been done with the process. This is now illegal. Federal law requires that the total before-tax price be displayed clearly to prospective customers, in all ads and listings.

2) Allowing them to fuck over travel agents. Resort fees were considered non-commissionable, the same way parking fees or room charges were. This allowed them to underpay travel agents their rightful commission for booking the room for a client. Unfortunately, this is still allowed today, though it doesn't directly affect the customer.

What about the whole thing about hotels claiming the resort fees are to support "local phone calls, gym access, in-room coffee", etc? That's always been a lie. It was a flimsy justification invented in the 2000s to shut people up who complain to the front desk. It was never true. In the mid-2000s when resort fees were just beginning, I was able to talk my way out of them by declining all of these "services", and eventually I got them taken off. This tactic no longer works, and hasn't worked in over 15 years.

Follow up- The law firm texted me asking for the reservation email I used when I booked at Santa Fe Station in 2024. I dont have that, so unless Station Casinos can produce it, I am out.

No, I do not follow Druff around. No, I would not play in traffic if anyone told me to. Now you seem to get the story backwards. I already started the process with the law office, THEN posted it here, THEN Druff said he had his doubts and THEN I get a text asking for an emailed reservation which I do not have, so I dropped it. Had I had the email, I would have submitted it just to see how har this goes.. But hey, way to make up your own story and twist all the facts around, like most liberals.

Ofccourse about Facebook, no duh, we all know this. But like I said previously above, I wanted to just respond and see how it plays out and where it goes. Its actually not a big deal at all, but but two of you really seem to be into it. Like I said, I have been following the resort fees for years and waiting to see when some legal action would happen. Nothing happened here, no big deal, but keep spazzing out over it I guess.

This is actually an interesting update, because it tells us what was going on with that Facebook ad.

Essentially there is no lawsuit, and they are fishing around to see if they can find violations of the new resort fee law, and at that point file suit.

This is the 2025 version of those ads you used to see on daytime TV in the '90s where it would say, "You may have been injured at work and not even know it yet! Call our injury hotline at 1-800-XXX-XXXX!"

So basically it's exactly what I thought it was.

The only time these ads can be useful is if it involves a situation where the law firm may not have access to everyone in the class. For example, "If you bought a chocolate shake at Sonic between January 3, 2025 and May 1, 2025, you may be entitled to compensation", because it was found that there was some illegal/dangerous ingredient in the shake. (I'm just making this up, by the way. There's nothing wrong with Sonic's shakes.) So in that case, putting out a general notice for class members to come forward would make sense, because they probably have no way to find out who everyone was that bought a shake (such as those who paid cash).

However, when it's a matter of a paper trail which would indicate whether you were part of the class or not, there's no need to respond to any of this bullshit.

Just to be clear here, I did post a pic graphic in Post #1 and clearly stated that there is currently NO lawsuit and I wanted to just see where this was going to go.

The false picture here was I took some bait as an ignorant dummy and Druff came in and educated me on this ad, NOT the case.

I clearly stated that I had been against the resort fees for years and just wanted to see what was going to pan out here as they clearly say in the graphic that they are exploring and investigating. If I had the confirmation email, I would have sent it just to see what was going to happen next.

Again and to be clear, I was playing along to see where this was going. Druff didn’t come along and school me, I was already cautious. I have been following the resort fees scam for years and just seeing how this was going to play out.
