The other player got 32k and last I heard they were processing his cashout. They did not put the my money back into the BBJ as this was obviously an attempt to pocket 53k. The sites rules state that only two players needed to be sitting at the BBJ table for it to be paid out, and we were playing HU.

Thanks for the help to all and especially Mr. Druff. It seems to be picking up steam and I have been in contact with Sportsbookreview.com and am hopeful that they will be able to talk some sense into them. I understand they have had some success in the past.
I think the rule change shows the attempted cover up of 5 dimes pretty clearly to anyone with a bit of critical thinking skills.
Pablo should get the BBJ. Any court would see this as the defendant trying to cover their tracks and he would win (also likely punitive damages).
5 Dimes management, I implore you to see the error of your (lower employee) ways -- there, I just gave you an out -- before this blows up.

I see Pablo's story is starting to make the Poker site headlines (see the second of two stories in that article)...shouldn't be long now before 5 Dimes gets spooked.
In another case shared on the 2+2 forum, poster pablo22 has claimed that the 5dimes sportsbook and poker site has denied him a $53k BBJ, claiming that because he started on the site via a freeroll he isn’t entitled to the prize.
This despite ‘Pablo’ using his freerolls winnings to go on to play real money cash games, paying around $2k in rake over the 3 years he has been on the site.
As Pablo recounts of his jackpot, “Last Friday I was playing a NL25 badbeat jackpot table, and the unthinkable happened. My quad eights were rivered by a straight flush. I was in shock as I am a working stiff and this [$53,000] is more money than I make in a year.”
His joy turned to disbelief as he was later repeatedly told by 5Dimes staff that because he hadn’t deposited he was ineligible for the payout – something which wasn’t in the site’s T&C’s until as recently as this year.
If the name 5Dimes sounds familiar to many, it’s likely because owner and founder William Sean Creighton, aka 5dimesTony, was allegedly kidnapped and feared murdered in Costa Rica back in October.
Doubtless the recent sad tales of unregulated sites scamming poker players will be repeated over and over – although hopefully airing such scams will go some way to limiting poker players’ vulnerability to the worst of them.

didn't realize it was hu not saying that makes it right but don't at least an x number of people be involved? Keeping the money as it appears they are doing is criminal.

Man that sucks pablo, I feel your pain. Fight this really hard, but do your best not to let it affect you emotionally. I think you have a decent shot at getting paid if you get enough exposure.

Actually, this story kinda went like it had to go. Seriously, Druff and others who figured out the "after the fact" rules change probably made all the difference. The "underlings" who made those rule changes on the fly probably never heard of Google cache/Wayback machine, etc.
A definite groundswell was starting for pablo and I think many poker news sites may have been ready to publish about this story --- after which 5Dimes smartly realized there was only one way out --- the right way. It felt like the bigger news sites were waiting for 5Dimes to reverse their decision. Which again, it looks like they did.

BTW, Creighton (Tony) has been called a lot of things, but one thing he has always prided himself on NOT being called is a thief (yes I used the present tense). Maybe it just took a long time for this story to reach Cuba via USB thumb drive...but when it did, he made a quick satellite burner phone call to whoever thinks they're running the show in Costa Rica right now.
