    Sports betting now technically legal in NJ

    New Jersey Gov. Chris Christie signed legislation Friday that partially repeals the state's sports betting prohibitions and clears the way for casinos and racetracks to begin taking bets as soon as next weekend. Monmouth Park, one of the state's oldest thoroughbred tracks, has said it will offer sports betting starting Sunday, Oct. 26.

    Christie signed the bill just one day after the state assembly passed the legislation with overwhelming support.


    I know there has been a long judicial process involved in this, including at least one loss in federal court by the state. I don't know the prospects of this getting overturned are. But it sounds like they're going to book action ASAP.

    id be very surprised if any casinos offered sports betting at this point...

    if im remembering correctly, Christie already challenged it in federal court as a state's rights issue and he got the big FU...

    too much risk for a casino to offer it and have the FBI storm in and shut the place down...AC is in enough trouble as is...

    Casinos won't offer it to start; Caesars has already confirmed this. Monmouth Park's attorney says the racetrack will attempt a soft rollout. It's very likely that the NFL, NCAA or DOJ will attempt to get an injunction against it some time next week, although the state's claimed legal powers regarding gambling issues might also come into play if that happens. The wildest, far-out scenario goes like this:

    a) Feds get injunction
    b) Monmouth Park goes ahead anyway, with the state's blessing
    c) Feds send in federal agents in an attempt to forcibly stop any active betting that's taking place, and/or arrest casino execs and workers

    Meanwhile, the state is expected to drop its attempt to get a further clarification in the older case, since they believe it's now moot. That decision wasn't going to be issued until Nov. 21st anyway.

    Interesting

    Sounds like what happened in Florida 5 or 6 years ago when the law was $100 max buy in anywhere but the Seminoles thought they didn't have to follow that rule until the feds showed up.

    NJ may have to secceed from the Union to have sports gambling.

    I don't understand how this is not a states rights issue. It's passed the NJ legislative branch and signed into law by the Governor.

    The reason its not a states right issue is because Federal law supersedes State law. Until PASPA is overturned, like the UIGEA, its moot.

    Nobody outside New Jersey gives a shit, so guess what, its not getting overturned.

    It's takes a powerful lobby to get a law rescinded, and a few gamblers and a couple state politicians are no match for the major sports leagues and Nevada.

    Move along, nothing to see here.

    -public interest in knowing whether state law is in conflict with federal law... seriously?

    Jesus. What is so difficult about this? Federal Judge sides with a 20 year old Federal law. This law has been on the books 15 years longer than UIGEA. It's not going anywhere.

    You might not like it, but its not going anywhere, unless it gets its way to the US Supreme Court, and that is a lottery ticket.

    It's not legal, at least for now.

    US District Judge Michael Shipp, who previously issued a temporary restraining order against the casinos trying to offer sportsbetting, has completely ruled against allowing sportsbetting in NJ.

    Shipp claims it violates the Professional and Amateur Sports Protection Act (PASPA) of 1992, which prohibits all forms of sportsbetting except in Nevada, with exceptions also carved out for "sports lotteries" in Oregon, Delaware, and Montana.

    New Jersey actually had an opportunity in 1993 to take advantage of a 1-year window where "states which operated licensed casino gaming for the previous ten-year period to pass laws permitting sports wagering". However, NJ stupidly didn't act upon this, and therefore is screwed.

    They plan to appeal the ruling, but appeals take about 8 months to be heard, and even then, it's likely they will still lose.

    Sorry, NJ sportsbettors.
