    This is the law he is referring to. Operating without a license. Something I am sure could draw a stiff fine if I had to guess.

    AN ACT relating to gaming; defining certain terms related to interactive gaming; requiring the Nevada Gaming Commission to adopt regulations authorizing the Governor to enter into agreements with other states to conduct interactive gaming; prohibiting the issuance of licenses to operate interactive gaming to certain persons; revising provisions related to interactive gaming; and providing other matters properly relating thereto.

    ***** Existing law authorizes certain gaming establishments to obtain a license to operate interactive gaming. (NRS 463.750)Sections 2-5*of this bill define certain terms for the purposes of determining whether a person may be found suitable for a license to operate interactive gaming.*Section 6*of this bill requires the Nevada Gaming Commission to adopt regulations authorizing the Governor to enter into agreements with other states to allow patrons of those states to participate in interactive gaming.

    ***** Existing law requires the Commission to establish by regulation that a license to operate interstate interactive gaming does not become effective until: (1) the passage of federal legislation authorizing interactive gaming; or (2) the United States Department of Justice notifies the Commission or the State Gaming Control Board that interactive gaming is permissible under federal law. (NRS 463.750)*Section 10*of this bill removes the condition that a license to operate interactive gaming does not become effective until the passage of federal legislation or notice providing that interactive gaming is permissible under federal law.*Section 10*also prohibits the issuance of a license to operate interactive gaming for a period of 5 years after the effective date of this bill for certain entities that, after December 31, 2006, operated interactive gaming involving patrons located in the United States. Finally,*section 10*authorizes the Commission to waive such prohibition if the Commission determines that those entities complied with all applicable provisions of federal law or the law of any state when, after December 31, 2006, those entities operated interactive gaming involving patrons located in the United States.

    ***** Section 11*of this bill authorizes the Commission to adopt regulations to increase or decrease the fees for the initial issuance and the renewal of a license for an establishment to operate interactive gaming under certain circumstances. (NRS 463.765)

    Warrant at hand, Micon told PokerNews that the accusations moved against him included the violation of the Nevada Revised Statutes NRS 463.750(10b), and the operation of an interactive gaming site without all appropriate licenses as required by State law NRS 463.160(1a). "I have looked these up, but I am not a lawyer and I did not really understand what this all means," Micon explained. He also added that the warrant issued by the NGC included "at least some other 10 similar points."

    (a) To deal, operate, carry on, conduct, maintain or expose for play in the State of Nevada any gambling game, gaming device, inter-casino linked system, mobile gaming system, slot machine, race book or sports pool;




    I'm not a lawyer either, but, it seems kinda self-explanatory. And ignorance of the law is no excuse, Mr. Micon...you know that.

    I was very surprised to read this claim that licensing is planned. The writer wasn't motivated to pursue that claim especially given the estimated start date for SWC 2.0 Kinda important, no?

    Well, there is plenty of fail to keep us entertained even if he becomes licensed.

    I don't know or care about Micon, but this just isn't true. Lawyers specialize in certain areas, her knowledge, or lack thereof in this area doesn't say anything about her competance.

    The regulated US sites are doing all kinds of things wrong.

    Some of it is simply because they are under the heavy hand of poorly written regulations, and are required to get regulatory approval with every small bug fix or tweak.

    Some of it is because they are poorly managing everything.

    Some of it is because they are partnering with shady operators like 888 with crap software. Ultimate Poker developed their own proprietary software, but they did a terrible job with it, and then prioritized all the wrong things, essentially ignoring valuable player input.

We have no idea how much of the old team was part of maintaining security, and without them, perhaps it could get even worse. I think the three biggest issues with him starting a new site are 1. competition from other sites that are starting to get into the game and 2. getting players confident enough to deposit on a site with this potential legal mess hanging over his head. 3. He needs to figure out a way for the new server/software to have less tech issues. People will only tolerate a site down for so long before they jump ship especially given new options that didn't exist before.

    There are a number of reasons to question viability of a new site and how stable it will be. However, I think questioning Micon's integrity as it pertains to keeping coins safe is unfair. I think he would do everything in his power to make sure players funds are safe. The question becomes is his new team as competent as his last team to make this happen.

    Very true. I was more referring to the fact that people hated on him for the general business concept (bitcoin poker site) than the legalities of it. As a business it worked and that by itself is pretty impressive. None of the other big poker sites had considered doing this until they saw the success of Seals.

    Being a doughy middle aged white boy with family I've been blessed with having been on my fair share of carabean cruises. I've been to some really nice islands... Aruba, St Marteen, St Thomas to name a few. I've also been to Hati, Jamacia and a few other islands that don't have the best of reputations and felt fine/safe the whole time.

    Two years ago I made my first and only trip to Antigua. I've never felt so uncomfortable in my life. Walking around the downtown area I couldn't help but feel like I was getting scoped out by every local in that shit hole. I'm not talking about the whole here comes the Gringo and I'm going to sell him an overpriced hat look. I mean the im going to pull a knife on his wife and take his roll look. Generaly speaking im a positive guy and don't expect the worst very often. The whole time I was on that island I felt like something bad was going to happen. My wife thought I was crazy and she's fairly street smart for a woman for whatever that's worth.

    Not sure if anyone else has any experience with this island?

    The only reason for him to be there, is if he is going to get a license. If not, then there is no point in being there, and in fact, it would probably be almost as bad of spot as Nevada to run the business from. Much like Nevada, I doubt Antigua gaming division (or the companies that actually pay the licensing fee) are going to happy with an unlicensed poker site being run by an American within its borders.

    If he launches this new site from Antigua without a license, he could be setting himself up for another raid.

    This whole thing makes no sense as I dont see how he gets a license before launch. Even if he has the money to do so, I imagine there is some process and it takes time to get approved.

    I hoping he isnt so naive to think that Antigua is some gambling utopia where he can do whatever he wants. He NEEDS a license or will get fucked just like he did in Nevada.
