Who says they are? Just because he looks like him doesn't mean shit. Unless he is saying "I'm Ben Stiller" or he is being presented as a character from one of his movies he can't do shit.

This is not true. I know Tom Waits, at least. succesdfully sued a company for making a commercial with a "Tom Waits type" in it. Not sure how many other cases there have been
